This paper explores sin and punishment of the Zhou Yi 周易, focusing on crimes and penalties, and moral guilt and punishments as a cause-and-effect relationship. In specific, ancient penalties shown in the Zhou Yi will be discussed. For instance, a penalty to imprison offenders in thorn-hedged prison walls(cong ji, 叢棘) and a punishment to let a offender sit on a beautifully patterned stone(jia shi, 嘉石) will be mentioned. This study seeks to address the ethical function of penalties that firstly cause a feeling of the offender’s shame, by exposing what he or she violated, and finally encourage repentance of a criminal. Furthermore, moral guilt and a corresponding punishment will be examined, arising from lack of discernment and judgement on right and wrong or moral mistakes without deliberation. Particularly, the Zhou Yi agrees that a human being can make mistake or do wrong sometimes, however, it takes precautions against the accumulation of moral guilt and mistakes. This paper explores the philosophy of the Zhou Yi that inevitable punishment for the accumulation of evil(ji bushan, 積不善 or ji e, 積惡) is compared to having superabundant misery and destroying one’s body(mie shen, 滅身), and therefore, the guilty person should have tremendous responsibilities since he or she have lost chances to repair an error and alleviate sin.

본 논문은 『주역』의 죄와 벌을, 범죄와 형벌, 도덕적 죄와 그 인과관계로서의 벌을 중심으로 살펴보고자 한다. 우선 『주역』에 담겨 있는 고대의 형벌, 특히 범죄의 경중에 대비하여 적용되는 가시나무 감옥(叢棘)에 가두는 형벌, 무늬가 있는 아름다운 돌(嘉石)에 앉게 하는 형벌을 살펴보고자 한다. 이를 통해 타인에게 범죄자의 죄를 노출시켜 수치심을 느끼게 하면서도 궁극적으로 자기 반성을 유도하는 형벌의 윤리적 기능을 살펴보고자 한다. 나아가 선･악에 대한 분별력과 판단력의 부재로 인해, 혹은 도덕적 과실로 인해 발생하는 도덕적 죄와 이로 인한 벌을 살펴보고자 한다. 특히 『주역』에서는 인간이 과실을 저지를 수 있는 존재임을 인정하지만, 도덕적 죄와 과실의 축적을 경계했다. 불선과 악을 축적한(積不善, 積惡) 데 대한 필연적인 벌을 넘치는 재앙, 몸을 망가뜨리는 滅身에 비유하며, 과실을 보완하고 죄를 해소하지 못한 행위 주체에게 그 막중한 책임을 묻는 『주역』의 사유를 살펴보고자 한다.
