The purpose of this study was to analyze prevention and protection policies against educational infringement in the United States and France and to draw policy implications for Korea. The results of the analyses are as follows. From a basic principles’ perspective, the United States and France maintain the principle that injuries to teachers' normal educational activities and physical violence are not tolerated in school education; both countries and societies work together to help schools realize educational values as safe spaces. In terms of processes, the United States and France periodically pursue scientific data collection and analysis in specialized research institutes to identify objective statuses and conditions of schoolteachers’ infringement of educational activities, and prepare alternatives based on the data. With regards to follow-up measures, the United States and France actively respond to the infringement of teachers' educational activities by students or outsiders by drawing upon the relevant legal basis for protecting the educational activities of school teachers. However, these countries seek to focus on prevention rather than punishment itself.

본 연구는 미국과 프랑스의 교육활동 침해 현황을 살펴보고 각국의 교육활동 침해 예방 및 보호 정책 사례를 분석한 후 우리나라에 주는 정책적 시사점을 도출하는 것을 목표로 하였 다. 분석 결과는 다음과 같다. 첫째, 기본 원칙적 측면에서 미국과 프랑스는 학교 교육에서 교사의 정상적인 교육활동에 대한 상해와 신체적 폭력은 절대 용인하지 않으며 이에 적극 대응한다는 무관용 원칙을 견지 하며, 학교가 안전한 공간으로서 교육적 가치를 실현할 수 있도록 국가와 사회 모두가 협력 시스템을 마련하여 해결방안을 강구하려는 노력을 지속적으로 기울이고 있다. 둘째, 대책 마련의 측면에서 미국과 프랑스는 학교 교사의 교육활동 침해에 관한 객관적인 현황과 실태 파악을 위해 전문 연구기관을 통한 과학적인 자료 수집과 분석을 주기적으로 추 진하고 그 자료에 근거하여 대책을 마련한다. 셋째, 후속 조치 측면에서 미국과 프랑스는 학교 교사의 교육활동 보호를 위해 관련 법적 근거를 기반으로 학생이나 외부인에 의한 교사의 교육활동 침해에 적극 대응하고 있다. 그러 나, 처벌 자체보다는 예방에 주력하고자 한다.
