Purpose : There isn't precise definitions on the Public Body in SCM Agreement. This paper intends to provide legal standards for Public Body. Research design, data, methodology : It analyzes the WTO agreements, precedent Panel reports, Appellate body decisions, comprehensive other legal texts. Results : It can probably be determined that state-owned enterprises were public bodies, because the government was the majority owner of these enterprises and therefore controlled them. Private company performing government functions under the government's approval can also be falled into Public Body definition. Conclusions : The government needs to carefully consider whether it is a Public Body in SCM agreement when supporting corporate restructuring through SOEs or enforcing industrial policies.

본 논문에서는 세계무역기구의 보조금 협정상 공공기관의 판단기준에 관한 연구가 미약하여 WTO 협정문과 판례, 미국 등 주요 국가들의 적용기준을 종합적으로 분석하여 이에 대한 기준 을 하고자 한다. 분석결과 공공기관에 대한 정부의 공공기관에 대한 소유와 통제, 정부 기능의 수행, 공공기관 의 행위 시 정부의 승인 등이 구체적으로 입증될 경우 WTO 보조금 협정상 공공기관(Public Body)에 해당할 수 있을 것으로 판단된다. 소유와 통제에 대해서는 정부의 지분비율이 일정 범위를 초과하는 경우 공공기관으로 인정을 받으며, 의사결정 시 정부의 참여 여부가 중요한 요인으로 판단된다. 따라서 정부가 공공기관을 통해 산업구조조정이나 간접 지원 정책을 펴면 보조금 협정상 공공 기관에 해당하는지를 사전에 철저히 검토하여 향후 무역분쟁의 위험성을 사전에 제거해야 할 것이다.
