A local council is a residents' representative body and the highest legislative organ of a local government regarding the enactment and amendment of regulations and the deliberation on and decision of the budget, and plays a very important role of monitoring and checking executive organs. In spite of the important roles of a local council, according to the system of the current ｢Local Autonomy Act｣, the head of a local government as a implementating agency can exert a much more influence than a local council as a legislative body. Because of this structural characteristic of a local government, the age-old conflicts and arguments about a local council's independent authority over human personnel or the introduction of the “paid aides” system have continued. The Jeju Special Self-Governing Provincial Council established in 2006 has secured some autonomy with regard to the organization and personnel according to the exemption law grounded on the ｢Special Act on the Establishment of Jeju Special Self-Goveroverning Province and the Development of Free International City｣, which is different from other city or province councils. In addition, the 'policy advisors system' known as the only 'policy aide' or 'collaborative aide' in Korea has been being operated for 14 years. It's the very model system of the 'professional policy assistant manpower' that the government has recently introduced through the ｢ Local Autonomy Act Revised Amendment Act｣ in order to support the activities of the council by the members of local councils as well as the independence of the authority over human personnel of a local council. In this thesis, the implications necessary for the discussion about the introduction of paid aides to support the activities of the council by the members of local councils were suggested through the legal consideration of the 'policy advisors' system of Jeju Special Self-Goveroverning Province as the leading model of the ‘professional policy assistant manpower’ proceeded by the government. Moreover, the 'Jeju-style of local council legislation supporting organization model' using the exemption laws of the ｢Special Act of Jeju｣ was proposed. In particular, the concepts of the paid assistant manpower were clearly defined as 'organizational level of assistant manpower' and 'personal level of assistant manpower' depending on their legal characteristics, and therefore this thesis was to contribute to the future stepwise systematization of the Organization and Human Resource System of a local council.

지방의회는 주민의 대표기관이자 조례의 제정 및 개정, 예산의 심의·의결 등 지방자 치단체의 최고의결기관으로서, 집행기관을 감시하고 견제하는 매우 중요한 역할을 담당하고 있다. 지방의회의 중요한 역할에도 불구하고, 현행 ｢지방자치법｣은 집행기 관인 지방자치단체장이 의결기관인 지방의회에 비해 막강한 영향력을 발휘할 수 있는 시스템으로 설계되어 있다. 이와 같은 지방자치단체의 구조적 특성으로부터 지방의회 인사권 독립이나 유급보좌관제 도입을 둘러싼 해묵은 갈등과 논쟁이 지속되어 왔다. 2006년 출범한 제주특별자치도의회는 ｢제주특별자치도 설치 및 국제자유도시 조 성을 위한 특별법｣에 근거한 특례에 따라 다른 시도의회와 달리, 조직 및 인사에 관한 일부 자율성을 확보하고 있다. 또한 전국에서 유일하게 ‘정책보좌관’ 또는 ‘공동보좌 관’으로 알려져 있는 ‘정책자문위원’ 제도를 14년째 운영 중에 있다. 최근 정부가 ｢지방자치법 전부개정법률안｣을 통해 추진하는 지방의회 인사권 독립과 함께, 지방의 회의원의 의정활동 지원을 위해 도입하는 ‘정책지원전문인력’의 모델이 된 제도이다. 본 논문에서는 정부가 추진하고 있는 ‘정책지원전문인력’의 선도적 모델인 제주특 별자치도의회의 ‘정책자문위원’ 제도의 법적 고찰을 통해, 지방의회의원의 의정활동 을 지원하는 유급보좌인력 도입 논의에 필요한 시사점을 제안하였다. 또한 ｢제주특별 법｣상의 특례를 활용한 ‘제주형 지방의회 의정활동 지원조직 모델’을 제시하였다. 특히, 유급보좌인력을 법적 성격에 따라 ‘조직 차원의 보좌인력’과 ‘개인 차원의 보좌 인력’으로 개념을 명확히 함으로써, 향후 ‘지방의회 조직 및 인사시스템의 단계적인 체계화에 기여하고자 하였다.
