Due to expanded personal and material resource exchanges between countries in the global era, the number of targets for foreign affairs management related to international crimes is increasing significantly. However, there is a limitation in regulating international maritime crimes based on current foreign affairs management organization and manpower of Korea Coast Guard. Unlike the coast guard in other countries, the coast guard in Korea has general jurisdiction. The matter that should be handled as important as the exercise of general jurisdiction in target cases managed by the coast guard is that most of these cases display internationality and expertise which are recognized as the major characteristics of maritime crimes. Therefore, it is necessary to establish a proper investigation structure of the coast guard in accordance with the characteristics of maritime crimes, systematize the foreign affairs function of Korea Coast Guard into international crime investigation function in order to optimize the international crime investigation capability of the coast guard, and prepare employment and education systems to allow investigation manpower in charge of such function to display professionalism. In addition, it is required to revitalize the exchanges of investigation information between countries and derive mutual assistance and cooperation from relevant investigation authorities both domestically and internationally for the investigation of internationalized maritime crimes. This study compared and analyzed the investigation status of general crimes and international maritime crimes between Korea Coast Guard and Japan Coast Guard, and proposed a direction of improvement in order to further develop the international crime investigation function of Korea Coast Guard.

글로벌 시대에 국가간 인적·물적 교류가 확대되면서 국제적인 범죄와 관련된 외 사관리 대상이 현저하게 증가하고 있으나, 현재의 해양경찰청 외사조직 및 인력으로 는 관련 국제해양범죄를 단속하는 데에 한계를 보이고 있다. 우리나라의 해양경찰은 외국의 해양경찰과 다르게 일반사법권을 가지고 있고, 해 양 관할에서 해양경찰이 대상으로 하는 사건들 중에서 일반적인 관할권의 행사만큼 이나 중요하게 다루어야 할 부분은 이들 사건 대부분이 해양범죄의 중요한 특성으로 인정되는 국제성과 전문성을 띠고 있다는 점이다. 따라서 해양범죄의 특성에 맞게 해양경찰의 수사구조를 이에 적합하게 갖추어야 할 것이고, 해양경찰의 국제범죄수사 역량을 최대로 끌어올리기 위해서 해양경찰청 외사기능을 국제범죄수사기능으로 체계화하며, 이를 담당할 수사인력이 전문성을 발 휘할 수 있도록 채용과 교육제도를 마련하여야 한다. 또한 국제화되는 해양범죄를 수사하기 위해 국가간 수사정보의 교류를 활성화하고, 국내외적으로 관련 수사기관 과의 공조와 협력을 이끌어내야 할 것이다. 본 논문에서는 우리나라 해양경찰청과 일본 해상보안청의 일반범죄 및 국제해양 범죄 수사현황을 비교하여 분석하고 우리나라 해양경찰청의 국제범죄수사기능을 더 욱 더 발전시키기 위한 개선방향을 제시하였다.
