This article is aimed for re-examining the oppressed view of the patriarchal society at that t ime by analyzing the distorted s tandards of criminalization for women and the converse way of punishment in classical literature works of Korea, China and Japan. First of all, the type of crimes that are unique to women in the patriarchal society was divided into two types: first, personal and ethical crimes such as jealousy and abuse, second types of social and institutional crimes such as sexual misconduct and forgoing her integrity, and then the types of punishments such as self-punishment of entering the Buddhist priesthood and suicide, second types of social punishment such as murder, and mutation. According to the study, both Korea, China and Japan have criminalized ethical lapses just because they are women, and even their ethical wrongs , or their patriarchal feelings , "jealous y," were condemned as evil. This mixture of "sin" and "wrong" and "evil" and "lust" aggravated the criminalization process with feudal standards for women at t hat time, and, b y res ponding in a m ore powerful manner in punishment, women were found to have suffered double pain.

본고는 韓･中･日 고전문학 작품 속에서 여성에 대한 정죄(定罪)의 왜곡된 기준 과 처벌(處罰)의 전도된 방식을 분석함으로써 당시 가부장사회의 억압된 여성관을 재조명하는 것을 목적으로 하였다. 먼저 가부장사회 속에서 발생된 여성 특유의 범 죄유형으로 1) 질투, 학대 등의 개인･윤리적 범죄 2) 음행, 훼절 등의 사회‧제도적 범 죄로 나누어 살펴보고, 이어서 그에 대한 처벌로는 1) 출가, 자살 등의 자기처벌 2) 타살, 형벌 등의 사회적･법적 처벌 3) 악몽, 변이(變異)등의 초현실적 처벌의 유형으 로 나누어 살펴보았다. 연구결과로는 고대 韓･中･日 삼국 모두 여성이라는 이유만 으로 윤리적인 잘못까지 형사적인 처벌을 하였고, ‘부정(不貞)’이나, 가부장적 사회 속 여성 본연의 감정인 '질투'조차도 악(惡)으로 정죄(定罪)되었음을 발견할 수 있었 다. 또한 이러한 '죄’와 ‘잘못’의 혼동, ‘악행’과 ‘욕망’의 혼용으로 인해, 당시 여성들 에게는 강력한 봉건적 잣대로 범죄화과정이 심화되었고, 처벌에 있어서도 보다 강력 한 방식으로 대응함으로써 여성들은 이중고(二重苦)에 신음하고 있었다.
