Nowadays the infringement of the crimes, including organized and cyber, committed by foreigners and domestics inside and outside Korea related is recorded, according the 2018 statistics of the Prosecution Office, increased up to the number of more than 34,800 cases than ever in which sexual crimes numbered around 1,000 cases. Like this, the crime dubbed “international crime or organized transnational crimes” relates always to the several nations and over the various international boundaries and necessarily intervenes with more than one nation’s criminal law and enforcement procedures though it violates one nation’s criminal law; because the criminals concerned can escape outbound the country from where they have committed the crime. In that case, the correcting and resolving the violent crimes induce many nations’ police forces and prosecution officials in terms of international cooperation in battling those trans-national and trans-boundary ‘organized and cyber’ crimes. This study aims at analyzing the Korean situation in combatting the abovementioned international crimes, occurred inside and outside Korean territory but always impacted to Koreans and its assets. For that analysis, we would like to find some difficulties and problems inherited in past and actual police enforcement practices fighting against those international crimes by reviewing various governmental documents and acamedic references, and by referring to the USA, France and EU international crime prevention and cooperation systems. In conclusion, this study suggests also the partial amendments of the Korean “International Cooperation Law in International Criminal Enforcement.”

현재 우리나라는 2018년 기준으로 국제범죄라고 할 수 있는 외국인에 의한 범죄발 생이 3만4천 건 이상이며, 성폭력도 1,000건 정도가 발생하고, 폭력은 8천 건 이상이 일어나고 있다. 국제범죄란 한 나라의 자국민이 국내에서 범죄를 저지른 후 국외로 도주하게 되는 경우, 또는 외국에서 범죄를 저지른 경우, 아니면 외국인이 거주하고 있는 다른 나라의 국가에서 범죄를 저질러 그 나라의 자국민에 대해서 그리고 그 나 라의 법익을 침해하는 복잡한 범죄 상황을 발생시키는 다차원의 문제들이 걸려있는 범죄 형태들이다. 이에 본 연구는 현재 우리나라의 국제범죄 퇴치를 위한 국제형사사법 상의 인터폴 등과의 국제공조수사 체계의 현황과 문제점을 분석하고, 경ㆍ검 수사권 조정을 반영한 국제공조수사 활성화 방안을 제안하고자 한다. 연구방법으로는 국내외 국제공조 범죄수사에 관련된 논문ㆍ학술자료, 실무자료 및 정부자료, 대한민국 경찰의 인터폴 활동ㆍ보고자료과 우리나라 사례 등을 먼저 검토한 후에 미국과 프랑스, EU 회원국에서의 인터폴 공조 수사와 관련한 법과 제도 및 국제공조 수사체계를 문제점을 중심으로 연구 분석한 후, 우리나라 제도 개선을 위한 몇 가지 해결방향과 법 개정안을 제안하고자 한다.
