The purpose of this study is to address the factors influencing on teachers' compliance with student human rights ordinance. This study hypothesized that teachers' compliance capability and willingness would be likely to influence on their compliance with student human rights ordinance on the basis of literature review. The teachers' compliance capability consisted of their fundamental virtue and external activity. Their compliance willingness consisted of their denial of the need and their negative perception of the ordinance. The analysis results of survey administered to teachers in the middle and high schools in Seoul City and Gyeonggi-do are as follows. First, the teachers' fundamental virtue, external activity, and denial of the ordinance need influenced on their compliance with student human rights ordinance. Second, their fundamental virtue had a strongest effect on their compliance with student human rights ordinance. Third, their negative perception of the ordinance had no effect on their compliance with student human rights ordinance. This study suggested that various opportunities for external activity should be given to teachers for the improvement in their fundamental virtue and compliance with student human rights ordinance.

본 연구는 교사들의 학생인권조례에의 순응에 어떠한 요인들이 영향을 미치는지를 실증적으로 분석하기 위한 것이다. 특히 정책순응요인에 대한 선행연구에서 도출해 낸 순응주체의 순응능력과 의지를 중심으로 교사들의 학생인권조례 순응요인을 설정하고자 하였다. 본 연구는 일선교사들과의 인터뷰 결과를 바탕으로 교사의 순응능력을 ‘기본적 자질’ 및 ‘인권관련 외부활동’ 등으로, 교사의 순응의지를 ‘학생인권조례 불필요성 인식’ 및 ‘학생인권조례 부정적 인식’ 등으로 구성하였다. 서울시 및 경기도에 소재하는 중학교 및 고등학교에 재직 중인 일선교사들에 대한 설문조사에 대한 분석 결과를 요약해 보면 다음과 같다. 첫째, 인권관련 외부활동, 학생인권조례 불필요성 인식, 기본적 자질, 담임교사 여부 등이 교사들의 학생인권조례 순응에 통계적으로 유의한 영향을 미치는 것으로 나타났다. 둘째, 교사의 기본적 자질이 다른 요인들보다 상대적으로 더 강하게 학생인권조례 순응에 영향을 미쳤다. 셋째, 학생인권조례에 대한 부정적 인식은 교사들의 순응에 통계적으로 유의한 영향을 미치지 못하였다. 이러한 연구결과를 바탕으로 본 연구는 교사의 기본자질 변화를 위한 다양한 교육과 외부활동이 필요함을 정책적 제언으로 제시하였다.
