Kunshan, a county in Jiangsu Province, is not only at the top of China’s top hundred county-level cities list in the economy and social development, but also the first city that puts forward and practices the concept of ruling county by law. Meanwhile, China’s researches of ruling county by law will be promoted if more similar investment-simples are conducted in other counties. Moreover, as an academic issue, what should be emphasized is the practice of ruling county by law. There are three inevitable questions in the exploration of this theory: the practicality of ruling county by law; the possibility of ruling county by law, and the meaning of ruling county by law. The exploration of ruling county by law should not only be regarded as research on the theory of rule of law, but also a practical issue from a comprehensive social aspect. While concentrating on the existing framework of this new theory, the importance of the latest progress of ruling county by law should also be emphasized. Investment-simples like Kunshan Volume should be viewed practically and realistically so that a systematic framework of the practice and theory of ruling county by law can be developed through the careful analysis of realistic problems as well as the sublimation and summarizing of theoretical principles.

절강성 쿤산시는 전국 100강 현(县) 중 최고의 현(县)일 뿐만 아니라, 경제 및 사회전 반의 인프라 발전에 있어서도 전국에 손꼽히는 ‘현역법치화’ 건설을 잘 실천하고 있는 도시이다. 현역의 법치 연구는 하나의 학술명제로서 주로 현역법치의 실현을 중점으로 하고 있다. 현역법치 연구에 있어 다음의 세 가지 문제와 반드시 마주하게 되는데, 즉, 현역법치가 가능한가?, 현역법치는 어떻게 가능한가?, 현역법치의 의의는 어디에 있는 가?의 문제이다. 그러므로 현역법치 연구는 단순히 하나의 법학적 연구로 인식하면 안되며, 현역법치연구가 종합적 연구로 인식되어야 한다. 이러한 새로운 명제에 대하 여 기존 이론에 주목하면서 현역법치에 신경을 써야 한다. 현재 중국 현역법치에 대한 연구가 매우 부족한 것이 사실이다. 단순히 법학적 연구 에서 보면, 중국의 주요문제는 법학학술연구를 기초로 이미 중요한 학술명제로 되고 있는 것이 학계의 공동인식이다. 현역법치 실시 현황을 연구함에 있어, 반드시 중국 현역의 발전실태에 대한 정확한 인식과 비전이 필요하다. 현역법치의 연구는 현역에 관한 문헌의 운용과 정리분석을 중심으로 현역법치의 내적 시각에서 현역법치 조사보 고서와 같은 문헌을 실사구시적으로 바라보는데 도움이 된다. 현역법치에 관한 연구는 최근 관심을 가지는 연구소제로, 이는 법치중국의 중국식 법학연구의 발전에 많은 관 심을 가져야 할 것이다.

县域法治研究作为一个学术命题的提出，关注的重点是当下县域法治实践。在县域 法治研究过程中，不可回避如下三个问题：县域法治是否可能？县域法治何以可能？县 域法治的意义所在？面对这样的一个新命题，关注已有理论的同时，应当注重当下县域 法治进程。以昆山县为例，县域法治研究应该对县域社会的实践调研，结合县域研究的 相关文献材料，回归县域本身，放空视野，推进县域法治研究。 对当代中国县域法治研究最为缺少的是真实可靠的文献资料。对法学研究而言，关 注中国问题，法律学术研究本土化，已经是一个重要的学术命题，也大致是学界的共 识。研究县域法治实施的情况，必不可少的是要对中国县域发展的实际情况有一个准确 的认知，才能有的放矢。县域法治研究要注重对县域文献的运用和梳理，从县域法治的 内在视角出发，实事求是地看待类似县域法治调查报告这样的文献，思考县域法治进程 中所面临的问题，抽象出县域法治背后的理论，将有助于推进县域法治的实践和理论研 究。关于县域法治的研究才刚刚起步，需要更多有识之士参与到这项研究中来，这对于 法治中国的建设以及法学研究中国化皆毗益。
