The Medical Law prohibits profit seeking from medical corporations to prevent profit sharing, but the Free Economic Zone Act and the Jeju Special Act allow the opening of a hospital with the permission of opening a for-profit medical corporation for foreign corporations. Medical law in the United States, Germany and Singapore allows for profit pursuit of medical corporations. Activation of for-profit hospitals to increase the number of foreign medical tourists and to optimize the treatment system, to meet the demand for high-quality medical services and to prevent the outflow of Korean patients, to create jobs in the health service market and to revitalize the local economy, and to supplement the problems in the operation of public medical corporations. In the Jeju Special Self-Governing Province, after a long time with Jeju autonomous residents, the Chinese real estate industry was allowed to open a foreign-only hospital as a subsidiary of the Administrative Act to the real estate industry in China as a subsidiary of the Administrative Act without the basis of the Jeju Special Law. 의료법에서는 의료법인에 대한 영리추구를 금지하여 이익분배를 하지 못하 도록 하고 있으나, 경재자유구역법과 제주특별법에서는 외국법인에 대한 영 리의료법인의 개설허가를 하여 병원을 개원할 수 있도록 하고 있다. 미국, 독 일, 싱가포르 등에서의 의료법에서 의료법인에 대한 영리추구를 허용하고 있 고 있다. 최근 외국 의료관광객 증가와 진료체계 적정화, 고급 의료서비스 수요충족과 내국인 환자의 해외유출 억제, 보건의료서비스시장의 일자리창출과 지역경 제 활성화, 공공의료법인의 운영상의 문제점의 보완을 위해서 영리병원의 활 성화가 요구되고 있다. 제주특별자치도에서는 제주자치도민과의 오랜 실랑이 끝에 중국의 부동산 업계에게 제주녹지병원에 대하여 제주특별법에도 근거가 없이 행정행위 부 관(조건)으로서 외국인전용병원으로 개설허가를 하였으나, 제주녹지병원은 이에 불복하여 개원조차 하지 않음에 따라 결국 영리병원을 첫걸음도 밟지 못하고 문을 닫고 말았다. 따라서 제주특별자치도지사의 녹지병원의 개설허가에 대한 위법성여부문제 를 검토한 후, 숙의민주주의 위반문제, 제주특별법상에 영리병원의 외국전용 병원 명문화의 필요성, 의료환자의 정보이용의 제한 규정 명문화, 요양기관 당연지정제도 합리화 등에 관하여 고찰함으로써 영리병원의 활성화 방안을 모색하고, 더 나아가 국민의 건강증진과 인간의 존엄과 가치가 향상될 수 있 도록 하는 방안을 강구한다.
