The overall business innovation through digitalization is crucial for small and medium-sized enterprises(SMEs) to lead the innovative growth. The digitalization helps business practices of SMEs to advance from a subcontracting manufacturing system in the industrial age to a customized service provider in the digital era. For SMEs, it is hard to obtain all capabilities and business resources on their own which the 4th industrial revolution require such as cutting-edge technology, logistics, technique and capital, accordingly sharing and combination is the key for achieving the competitiveness. And the growing interdependence with the outside entities in providing product, services and information data bears a higher probability of a rapid and wide spread of specific company’s hazard or accident through supply chain or network. Digital Transformation unfolds at rapid pace. In this situation, SMEs with business resources limit coupled with the information protection divide between the big businesses need the foundation for strengthening the information protection capability and the proactive response form the government. Under existing legislation which lacks clear basis for SMEs support, organized cyber safety net boosting project support has limit. Therefore laying the legal grounds for effective information protection is necessary. To this end, this article is for reviewing the discussion on current status and improvement of SMEs information protection support legislation.

중소기업이 혁신성장에서 주도적 역할을 수행하기 위해서는 디지털화를 통한 경영 전반의 혁 신이 필수적이다. 디지털화를 통해 중소기업의 사업방식은 산업화 시대 하청 생산에서 디지털 시대 특화된 서비스 제공으로 도약할 수 있다. 중소기업은 4차 산업혁명이 요구하는 첨단기술, 물류, 기술, 자본 등의 경영자원을 독자적으로 모든 역량을 확보하는 것은 어려워지게 되며 공유 와 결합을 통해 경쟁력을 확보해야 한다. 따라서 상품과 서비스, 정보데이터의 제공을 통한 외부 조직과의 상호의존성이 증가함에 따라 특정기업의 장애나 사고가 공급망(supply chain)이나 네트 워크를 통해 빠르고 광범위하게 확대될 가능성이 높아지고 있다. 앞으로 디지털 트랜스포메이션 (Digital Transformation)의 흐름이 빠르게 전개되는 가운데 경영자원상의 한계를 가지고 있는 중소 기업의 경우, 대기업과의 정보보호 격차도 크게 벌어지고 있는 상황에서 정보보호 역량강화의 기반을 마련하고 정부 차원의 적극적인 대응이 필요하다. 중소기업 정보보호 지원에 관한 명확한 근거가 없는 현행법제하에서 체계화된 중소기업 사이버안전망 강화 사업 지원에 한계가 있고, 중소기업의 정보보호를 효과적으로 추진할 수 있도록 법적 근거 마련이 필요하다. 이에 따라 본 고에서는 중소기업을 둘러싼 정보보호 지원 관련 법제현황과 개선방향에 대한 논의를 검토하고 자 한다.
