Worldwide, voices calling for regulating the distribution of false information on social media are not limited to Korea. France has already legislated regulations on the distribution of disinformation, and discussions on the introduction of strong regulations at the government level in the U.S., the U.K., and Singapore are active. The first challenge of introducing regulations on the distribution of false information was to define the 'false information,' or what it was subject to, that would ban distribution. In this paper, we will first reveal what the substance of disinformation we want to ban distribution in light of the current state of regulations at home and abroad regarding 'false information'. Also, the government will identify the origin of regulations on the distribution of disinformation that are discussed in Korea based on the revised bill on the Information and Communication Network Act proposed to the National Assembly, and examine whether regulations on the distribution of false information through self-regulation, which is legally enforced in social media areas where plurality is emphasized, are valid from a legal point of view.

최근 소셜 미디어에 대한 허위정보 유통을 규제하자는 목소리는 국내에 국한된 것이 아니다. 이미 프랑스와 독일은 허위정보 유통 규제를 입법화하였으며, 미국, 영국, 싱가포르 등에서도 정부 차원의 강력한 규제 도입 논의가 활발히 이루어진다. 허위정보 유통 규제 도입의 첫 번째 난제는 유통을 금지시킬 ‘허위정보’, 즉 규제 대상이 무엇인지 정의하는 일이었다. 본 논문에서는 먼저 ‘허위정보’와 관련한 국내외 규제 현황에 비추어 유통을 금지하고자 하는 허위정보의 실질이 무엇인지를 밝힌다. 그리고 국회에 발의된 정보통신망법 일부개정법률안을 중심으로 국내에서 논의되는 허위정보 유통 규제의 골자를 파악하고, 결정적으로 다원성이 강조되는 소셜 미디어 영역에서 법적으로 강요된 자율규제에 의한 허위정보 유통 규제가 공법적 관점에서 타당한 것인지 검토한다.
