This study analyzed the contents of 1947 and 1951 Registration of Foreigners Ordinance, Registration of Foreigners Act and Immigration Control Ordinance of Japan and the disputes in their establishment process in order to investigate the characteristics of Japan’s foreigner policy after its war defeat. The postwar Japanese foreigner policies mainly targeted Koreans and Taiwanese living in Japan. They accounted for over 90% of foreign people living in Japan without Japanese nationality. Given remarks from Japanese government officials, the Japanese government did not have favorable thoughts about them. It wanted to deprive their nationalities and grant the status of alienage separate from Japanese nationals. But such an intention of the Japanese government did not succeed completely. Both Koreans and Taiwanese living in Japan did not choose the nationalities of Republic of Korea and Republic of China in the process of selecting their nationality. Since the Japanese government recognized as nation the Republic of Korea (led by Rhee Syngman government) in the Korean Peninsula and Republic of China (led by Chiang Kai shek government) in China, it did not recognize any other nationality than them. Japan’s National Diet raised an issue with such a situation. After all, although the Japanese government was successful in depriving these people of their nationalities, it ended up being unable to force them to have a foreign nationality. Still, the national government did not give away the administrative authority to unilaterally and arbitrarily deal with the terms and procedures of deporting people without Japanese nationality. In other words, although the foreign policies established by the Japanese government after its war defeat show its clear intention of discrimination and exclusion from the perspective of legislation process as argued for in preceding study, it cannot be said as a complete success.

본고는 1947년과 1951년의 외국인등록령, 외국인등록법 그리고 출입국관리령의 내용과 그 제정과정의 논쟁을 분석하여 패전 후 일본의 외국인정책의 성격을 규 명하고자 하였다. 패전 후 일본의 외국인 정책의 주요 대상은 재일코리안과 타이 완인이었다. 이들은 일본에 거주하지만 일본 국적을 갖지 않은 주민의 90%이상 을 차지하고 있었다. 일본정부 관계자의 발언을 보면 일본 정부는 이들에 대해 호의적인 생각을 갖고 있지 않았다. 이들의 국적을 박탈하고 일본국민과 분리된 외국인 신분을 부여하고 싶었다. 그렇지만 일본 정부의 의도는 완전하게 성공하 지 못했다. 재일코리안과 타이완인들 모두는 국적을 선택하는 과정에서 대한민국 과 중화민국 국적을 선택하지 않았다. 일본 정부는 한반도에서는 대한민국(이승 만정권)을 중국에서는 중화민국(장제스정권)만을 국가로 인정하였기에 이 국가 이 외의 국적은 인정하지 않았다. 이러한 상황은 국회의 논의과정에서 문제로 제기 되었다. 결국 일본정부는 이들의 국적을 박탈하는 것까지는 성공하였지만 이들에 게 외국의 국적을 강요하지 않는 선에서 마무리가 되었다. 그렇지만 일본국적을 갖지 않는 사람들에게 대한 추방의 조건과 절차는 행정부가 일방적이고 자의적으 로 할 수 있는 내용을 양보하지 않았다. 즉 패전 후 일본 정부가 수립한 외국인 정책은 법규의 제정과정에서 보아도 기존 연구에서 주장하는 차별과 배제라는 명확한 의도가 보이지만 완전하게 성공 했다고는 할 수 없다.

본 한국일본학회는 일본관련 학회로는 1973년에 한국 최초로 성립되어 2015년 3월 현재 가입회원수 기준 1000여명에 달하는 방대한 학회로 발전하였다. 본 학회는 일본어학 및 일본학은 물론,일본의교육,사상,역사,민속 등 일본학 전반에 걸친 연구와 한일간의 일본학 전반에 걸친 비교 연구를 대상으로 하는 학회로서 회원들의 연구기회 제공과 정보의 교류를 주된 목표로 하고 있다. 분회 발표를 포함하여 매년 20회 가까운 학술발표회와 국제학술대회를 개최 함으로서 발표 기회의 제공과 함께 회원 상호간의 친목 도모의 장으로도 활용하며 건전한 학회발전을 지향하고 있다.
