The affairs related to marine pollution control of Korea coast guard are specified in Article 43 of the Government Organization Act and Article 14 of the Korea coast guard Act in effect on February 21, 2020 The current Marine Environment Management Act has a wide range of related fields and a large number of related agencies, which makes integrated and efficient business processes difficult. In particular, in order to prepare for environmental changes at sea such as strengthening new regulations and to protect people’s lives and property in the event of a disaster of marine pollution, it is necessary to establish an institutional basis to reduce the gap between on-site control policy and execution of field work. In other words, for the efficient execution, specialization of work, it is necessary to divide it into individual law system, which is a law on marine pollution control, which extracts marine pollution control field from various and complicated current single law system. As the diversification of the Marine Environment Management Act is being made continuously, the Maritime Police Agency, which is the general authority for the control of the Marine Affairs Act, will also enact individual laws so that lefislative purposes can be more clearly established. In addition, it is expected that various matters such as securing resources and budget will be implemented more systematically and actively.

해양경찰의 해양오염방제에 관한 사무는 ｢정부조직법｣ 제43조와 2020년 2월 21일 에 시행되는 ｢해양경찰법｣ 제14조에 명시하고 있으며, 해양수산부 소관 법률인 ｢해 양환경관리법｣ 중 일부 조항에 근거하여 업무를 수행하고 있다. 현행 ｢해양환경관리법｣은 관련 분야가 방대하고 다수의 관련기관이 산재되어 있 어 통합적·효율적 업무처리가 어려우며, 특히 새로운 규제 강화 등 해양에서의 환경 변화에 대비하고, 재난적 해양오염사고 발생 시 국민의 생명과 재산을 보호하기 위 해서는 현장에서의 방제 정책과 현장 업무의 집행사이 간극을 줄이기 위한 제도적 기반 마련이 필요하다. 즉, 업무의 효율적 집행, 특성화·전문화하기 위해서는 다양하 고 복잡한 단일법 체계의 현행 ｢해양환경관리법｣에서 해양오염방제 분야를 발췌한 ｢(가 칭)해양오염방제에 관한 법률｣인 개별법 체계로 분법 할 필요성이 있다. 현재 ｢해양환경관리법｣의 분법화가 지속적으로 이루어지고 있는 추세이므로, 방제 업무 총괄기관인 해양경찰청에서도 ｢(가칭)해양오염방제에 관한 법률｣을 제정하여 개별법화 함으로써 해양오염방제라는 보다 명확한 목적의 입법적 설정이 가능하며, 이에 관한 자원, 예산 확보 등 제반사항도 보다 체계적이고 적극적으로 이행할 수 있을 것이라 사료된다.
