This study deduced problems through the review of the characteristics of fishing boats and previous studies and the analysis of fishing boat accidents, and suggested institutional improvement plans by reviewing the Japanese fishing boats and small ship management system. As for institutional improvements, ① new and institutionalized training courses for small-sized ship pilots, ② improvement of license acquisition system for small-sized ship pilots, ③ qualifications for fishing boat operators and safety personnel, ④ establishment of self-work regulations and reporting system for fishing boats, ⑤ institutionalization of emergency training in fishing boats, ⑥ duty to inspect before departure were proposed, ⑦ improvement of the fine imposition system. Such amendment of the law will not guarantee safety. The awareness of fishing boat workers is also very important. The risk of marine accidents increases, such as collision with vessels anchored in the waters around the route by speeding to arrive at the best point first. If a number of fishing boat accidents occur, the number of fishing users who enjoy fishing will decrease. When fishing users decide that sea fishing is a safe and very good leisure, they will go to the sea more. Fishing boat workers should think that safety is more important than focusing on making money. It is expected that the advanced fishing culture can be settled by the autonomous purification of the fishing boat workers, not by the rule of the state.

본고는 낚시어선의 특성 및 선행연구의 검토와 낚시어선사고 대책분석을 통하여 문제점을 도출하고, 제도적 개선방안을 제시하였다. 제도적 개선방안으로 ① 소형선박 조종사 양성과정의 신설 및 제도화, ② 소형선 박조종사 면허취득제도의 개선, ③ 낚시어선업자 및 안전요원의 자격, ④ 낚시어선업 자의 자체업무규정 제정 및 신고제도 신설, ⑤ 낚시어선에서의 비상훈련 제도화, ⑥ 출항전 검사의무 부과, ⑦ 과태료 부과제도의 개선을 제안하였다. 이러한 법률개정 만으로 안전이 확보되는 것은 아닐 것이다. 낚시어선 종사자들의 의식도 매우 중요하다고 생각된다. 가장 좋은 포인트에 먼저 도착하기 위해 과속을 하여, 항로주변 해역에 정박 중인 선박들과 충돌하는 등 해양 사고의 위험성이 증가하게 된다. 낚시어선 사고가 다수 발생할 경우 낚시를 즐기는 낚시이용객이 줄어들 것이다. 낚시이용객이 바다낚시가 안전하고 매우 좋은 레저라 고 판단하였을 때 더 많이 바다에 나가게 될 것이다. 낚시어선 종사자들은 돈벌이에 치중하기 보다는 안전이 더 중요하다는 생각을 가져야 한다. 국가의 법령에 의한 타 율적인 통제가 아니라 낚시어선 종사자들의 자율적인 정화에 의해 선진적인 낚시문 화가 정착될 수 있기를 기대해 본다.
