In modern society with the rapid development of technology, the risk to young children and adolescents of exposure to sexual exploitation through instant chat applications and the Internet is growing, in line with the ease of accessibility and anonymity of the online environment. This study explored the current situation and the problems of legislation for sex protection of young children and adolescents age of consent (statutory rape), and sting operations relating to child sexual exploitation in South Korea. Based on the current status and problems described, this study examined online grooming legislation in different countries, evidence of the age of consent, and policies of sting operations. Through this analysis, improvement schemes have been suggested. According to our research, first, the countries we examined have established online grooming related law to deal with online-based sexual exploitation of young people, and by extension with offline sexual exploitation. Secondly, most of the countries state 16 as the age of consent to protect young people, who are much more vulnerable to sexual exploitation. Thirdly, in order to protect children and youths as a proactive measure, sting operations for perpetrators of sexual exploitation is partly allowed to investigate a related crime, and to obtain evidence. In conclusion, in line with the rapid movements of foreign countries, it implies that an active response to online-based sexual exploitation against young people is necessary in South Korea.

본 연구는 기술 발달이 급격히 이루어지고 있는 가운데 스마트폰의 보급화 및 발달에 따라 쉬운 접근성과 익명성이라는 온라인의 특수한 환경과 맞물려 채팅 애플리케이션, 인터넷 등을 통해 아동·청소년이 성착취에 노출될 위험성이 커지고, 온라인 기반으로 한 아동·청소년 성착취에 대한 문제가 지속적으로 제기되고 있으므로 우리나라의 아동·청소년 성착취와 관련한 아동·청소년의 성보호에 관한 법률, 형법 의제강간 법제 및 함정수사의 현황과 문제점을 살펴보았다. 이를 기반으로 영국, 호주, 미국의 일부 주의 온라인 그루밍 법과 의제강간 연령상향에 대한 근거를 살펴보고 함정수사의 제도를 검토함으로써 성착취를 근절하기 위한 개선방안을 제시하였다. 연구 결과, 온라인 그루밍법을 제정하여 온라인상에서만 이루어지는 성착취와 더 나아가 오프라인으로 이루어지는 성착취 또한 대응하고 있다. 해외 대부분의 국가가 의제강간 연령을 만 16세로 설정하여 성착취에 취약한 아동·청소년을 보호하고 있었다. 사전적 조치로 아동·청소년을 보호하기 위해 함정수사 일부를 허용하여 성착취 가해자를 대상으로 함정수사를 진행하고 있었다. 해외의 발빠른 움직임에 맞추어 우리나라 또한 온라인 기반 청소년 성착취에 대한 적극적인 대응이 필요함을 시사한다.
