• PURPOSE: This study was implemented in order to analyze the legislative process and policies of ｢Act of H&APWD｣ that originated from tow original draft Bills proposed by a member of the National Assembly(hereinafter referred as member's Bill), because of Statutory Articles 8 of 10 of「Act of H&APWD」that was enacted in 2015(the 19th National Assembly) have been proven ‘overlapping legislation'. • RESULT: 󰋻the first stage of legislative process(stage of drafting Bill): The ‘principles of legislative drafting' and ‘pre-examination of Bill' were not applied to two original member's Bills. But Government Bills is applied by laws and rules. 󰋻the second stage of legislative process(stage of deliberation Bill): 8 Articles of ‘overlapping legislation(dead letter)' was not scrutinized in the Health and Welfare Committee of National Assembly and the draft-Bill-subcommittee of the Health and Welfare Committee of National Assembly. 󰋻policies of 10 Articles: Policies of 8 Articles have been implementing by the ｢Act of Welfare of PWD｣. Policies of 2 Articles is implemented ｢National Health Insurance of Act)｣. • CONCLUSION: In case of making or reforming legislation by member's Bills, ‘principles of legislative drafting’ and ‘pre-examination of Bill’ as a tool of making ‘good legislation’ should be applied by laws and rules.

본 연구는 2개 의원입법안을 원안으로 하여 2015년(19대 국회)에 제정된 ｢장애인건강권 법｣에 있는 장애인 건강에 직접적인 영향을 미치는 10개 법조항 중 8개 법조항이 ‘법률 중 복’을 보임에 따라 ｢장애인건강권법｣의 입법과정과 정책을 분석하였다. 의원입법안의 경우 정부입법안과 달리 1단계 입법과정인 입안 단계에서 ‘입안원칙’이나 ‘사전 입안 심사 제도’가 법령으로 운영되지 않는 문제가 있었다. 2단계 입법과정인 국회 복지위 법률안 심사 단계에서 ‘법률 중복’ 문제가 제대로 여과되지 않았다. 법률 중복을 보이는 8개 법조항의 정책은 ｢장애인복지법｣ 등과 같은 기존 법률에 따라 이미 시행되고 있는 정책이다. 법률 중복 이외에 ｢장애인건강권법｣에 따라 시행되는 2개 법조항의 신규 정책도 ｢국민건강보험법｣이라는 다른 법률에 의해 시행되고 있다. 의원입법안으로 법률이 제정되거나 개정될 때 정부입법안과 같이 ‘좋은 법률(good legislation)’을 만드는 도구인 ‘입안원칙’과 ‘사전 입안 심사 제도’를 법령으로 의무화할 필요 가 있다.
