This study recognizes the seriousness of the current situation, which is constantly threatening the safety of railway workers and the people using trains, including train attendants, and aims to come up with effective institutional improvement measures. To this end, we will look at the concept and type of illegal activities in trains, analyze the trends of illegal activities in trains and the actual cases of illegal activities in Korea, find the causes and problems, and present effective institutional improvement measures for illegal activities in domestic trains. Therefore, effective measures of illegal activities in trains are proposed as follows. First, it is necessary to strengthen punishment rules for illegal acts such as smoking, sex crimes, violence, intimidation, and abusive language on trains, and second, to improve initial response capabilities to illegal acts on trains through continuous education and simulated training among relevant agencies, and third, to establish a control tower that can quickly command each organization.

본 연구는 열차 내 불법행위의 증가와 철도승무원 등 철도종사자와 열차를 이용하는 국민들의 안전을 지속적으로 위협하고 있는 현 상황의 심각성을 인지하고 이에 대한 효과적인 제도적 개선방안을 마련하 고자 한다. 이를 위해 열차 내 불법행위에 대한 개념과 종류에 대하여 살펴보고, 열차 내 불법행위 추이 와 실제 국내에서 발생한 불법행위 사례를 분석하여 그 원인과 문제점을 찾고, 국내 열차 내 불법행위에 대한 효과적인 제도적 개선방안을 제시하고자 한다. 따라서 열차 내 불법행위에 대한 효과적인 대책을 제시하면 다음과 같다. 첫째, 열차 내 흡연, 성범죄, 폭력, 협박, 폭언과 같은 직무집행방해 등의 불법행위에 대하여 처벌규정 을 강화하고 둘째, 지속적인 교육과 유관기관간의 모의훈련을 통해 열차 내 불법행위에 대한 초기대응 능력을 향상시키며 셋째, 상황별 구체적 대응방안이 가능하도록 매뉴얼 및 지침서를 만들고 각 기관을 신속하게 지휘할 수 있는 컨트롤타워를 설치 지정하여 열차 내 불법행위에 대해 신속하게 대응 할 수 있는 협력체제의 구축이 필요하다.
