The conscripted policemen system in South Korea is scheduled to be abolished completely by September, 2023. The Korean National Police Agency(KNPA) initially had a plan to employ additional police personnel to compensate for the expected loss of manpower following the abolishment, but the public safety needs cannot be met through such measure alone, especially considering the fact that the conscripted police officers have performed numerous security-related duties at police facilities. Therefore, utilizing registered security guards has been suggested as an alternative, because they are authorized to carry out police duties in exigent circumstances as prescribed in the Act on the Performance of Duties by Police Officers. Before developing and implementing a plan to assign registered security guards to the police agencies, one thing to consider is whether police facilities are classified into a “placement site.” Moreover, whether designating one person (i.e. commissioner) as the petitioner for service as well as the main supervisor in charge of assigning and authorizing employment is allowed according to the enforced laws must be reviewed. It is also important to discuss a possible complication in regard to the chain of command within the police when the commissioner general of the KNPA is the petitioner of security service. As per the provisions of Registered Security Guard Act, in this particular case, the commissioner of the police agency becomes the supervisor for the commissioner general, the petitioner. In this study, the authors review and offer legislative recommendations to overcome the aforementioned issues.

경찰청은 2023년 9월에 의경제도를 완전히 폐지할 예정이다. 경찰청은 의경 폐지에 따른 대규모의 치안 인력 공백을 막고자 경찰관을 추가적으로 채용할 계획이 있으나, 신규 경찰관의 증원만으로 치안공백을 모두 해결할 수는 없다. 특히, 의경을 활용하였 던 수많은 경찰청사 시설경비에 커다란 영향을 미치게 된다. 현재, 경찰청사에서 의경을 대체하는 방호인력으로는 청원경찰, 특수경비원, 방호원 등이 거론되고 있다. 그런데 직무권한과 관련하여 청원경찰은 긴급상황 발생 시 직무 범위 내에서「경찰관직무집행법」준용에 따른 경찰관의 권한을 대부분 행사할 수 있기 때문에 가장 유력한 대안으로 검토되고 있다. 그러나 경찰청사 시설경비에 청원경찰을 활용하기 위해서는 현행법상 그것이 허용 되는지 그리고 허용된다면 어느 정도까지 허용되고, 허용되지 않는 부분이 있다면 어떤 대안이 필요한지에 대한 법적인 검토가 선행되어야 한다. 먼저, 경찰관서가 청원경찰의 ‘배치대상 시설’에 해당하는지 여부가 검토되어야 한다. 그리고 ‘배치대상 시설’에 해당 하더라도, 청원주(경찰관서장)와 청원경찰의 배치결정.임용승인.지도감독권자가 동 일한 상황이 발생하는데, 이러한 경우가 현행법상 허용되는지도 검토해야 한다. 이외에 「청원경찰법」상 경찰청장이 청원주일 경우, 외형상 상급관청장이 하급관청장의 승인 또는 지도감독을 받아야 하는 경찰 조직체계상 ‘상하기관 간의 규율의 역전현상’문제가 발생할 수 있으므로 이도 가능한지에 대한 검토가 필요하다. 이 연구에서는 이러한 문 제들에 대하여 법적인 검토를 하고, 경찰관서에서 청원경찰을 배치ㆍ활용하는 것과 관련된 법적 논란을 해소할 수 있는 입법적 개선방안을 제시하였다.
