Japanese clinical research system consists of Japanese distinctive three-layer structure based on medicine clinical trial, clinical research of unapproved medicine by Japanese distinctive clinical research method and ethical guidelines in medical science. This research examined focusing on 「Ethical Guidelines in Medical Science」 and 「Clinical Research Method」 which are recently enacted in the structure and looked over its characteristic. First, the characteristic of 「Ethical Guidelines in Medical Science」 is to clarify and extend the definition of invasiveness, that is to say, the obstacle and burden of mental has been added in the definition of 「invasiveness」, and the invasiveness also includes the question about painful experience that he/she does not want to think(for example disaster, accident, abuse, past serious illness and symptom). In addition, besides the case by questioning, 「invasiveness」 also includes to burden the mental of subject through hurting the mental tranquility as intentional tension and anxiety. Clarifying explanation contents as intervention situation and explanation method on consent procedure after explanation, registering and opening of the subject and range regardless of clinical research’s invasiveness, and reinforcing the function of ethics committee are also characteristics. Next, the main content of clinical research method is to secure the transparency of researcher’s profit inconsistency management and pharmaceutical companies’ funding and labor that is to prevent the negative handling of clinical research data of hypertension treatment, Diovan(general name : Valsartan). However, the coverage of clinical research method is limited and operated to prevent the shrinking of clinical research because of focusing the researcher’s profit inconsistency management. Especially, it is worth examining the concrete contents on the clinical management planning procedure, clinical research funding contract and information announcement to solve the clinical research problem in Korea.

일본의 임상연구 체계는 치험, 일본 특유의 임상연구법에 의한 미승인약 등의 임상연구, 그리고 의학계윤리지침에 근거하는 일본특유의 복잡한 3층 구조로 되 어 있다. 그리고 본 논문에서는 이러한 구조하에서 최근에 제정된 「의학계윤리지침」과 「임상연구법」을 중심으로 검토하고 그 특징을 살펴보았다. 먼저, 「의학계윤리지침」의 특징은 침습의 정의를 명확히 함과 동시에 확장 한 것이다. 즉 「침습」의 정의에서 정신에 대한 장애 또는 부담이 새롭게 추가 되었다. 즉 그 사람이 생각하고 싶지 않은 괴로운 체험(예컨대 재해, 사고, 학대, 과거의 중병이나 중증 등)에 관한 질문도 침습에 포함시키고 있다. 또한 이 러한 질문에 의한 경우 외에도 예컨대 연구목적으로 의도적으로 긴장, 불안감을 주는 등 정신상의 평온함을 해침으로서 연구대상자의 정신에 부담이 생기게 하 는 것도 「침습」에 해당한다. 또한 설명후 동의절차에 대하여 설명방법과 개입상황에 따라 설명내용을 명 확히 한 점, 임상연구의 침습성의 유무와 관계없이 연구대상과 범위를 등록·공 개하도록 한 점, 윤리위원회의 기능을 강화한 점이 특색이다. 다음으로 임상연구법은 고혈압치료제 Diovan(일반명: Valsartan)의 임상연구 데이터 부정취급에 대한 재발방지책으로 연구자의 이익상반관리, 제약기업 등의 자금제공·노무제공의 투명성 확보가 주된 내용임을 알 수 있다. 그러나 연구자 의 이익상반관리에 집중한 나머지 임상연구의 위축을 방지하기 위하여 임상연 구법의 적용범위를 제한하여 운용하고 있다. 특히 임상관리계획절차와 임상연구 자금제공계약 및 정보공표에 대한 구체적 내용은 우리나라의 임상연구 문제 해 결을 위해서도 검토해 볼 가치가 있다고 본다.
