It is a matter of course required for the realization of the unification of the South and the North to form an integrated education law system. But It is very difficult to propose an integrated education law system without knowing what the political system of unified Korea because the ideology and purpose of the law to be included in the law and the values to be realized are closely linked to the political system like. It is even more so that the current South and North Korean political system and the ideology of the state and the function and role of the law are different from each other, bringing together the legal system of the two and presenting alternatives. Analyzing and interpreting the uniform and controlled North Korean education law system from the viewpoint of education law of a liberal democracy may reach a wrong recognition of North Korea pursuing a different political system and national ideology. In order to prepare the education law, it is necessary to understand the legal system of North Korea. According to the direction and form of unification, the system of education for South and North Korea integration can be different from that of South and North Korea. However, one thing is clear that the educational ideology of the South and North Korean integrated education system is based on the free democracy. It should be the ideology that pursues the universal value of mankind, that is, the dignity of human beings and the respect of basic human rights of the people. The educational ideology for promoting and maintaining a particular political system or regime has already lost its value as an educational ideology. It is necessary to provide institutional characteristics that set educational ideals that pursue universal value and serve as advantages in South and North Korea's education system as contents of integrated education law. South Korea's academic recognition system emphasizing the competitive and efficient aspects of education and the national social obligations to North Korea's educational welfare programs and institutional arrangements for realizing equality of education are institutions that are worthy of being included in the unified education law system.

우리의 당면과제인 통일을 염두에 둔다면 북한법제의 연구는 특정분야를 별론 하고 그 어느 경우도 경시될 수 없을 것이며, 교육법제 또한 예외가 아니다. 남⋅북한의 통합된 교육법제의 정비 없이는 통일을 준비할 수 없기 때문이다. 교육을 통한 통일국가의 국민의 양성은 하나의 국가에서 분열과 갈등 없이 하나의 정치체제 속에서의 하나 된 시민의 양성이라는 교육이념을 실현하는 수단이 된다. 본 논문에서는 남북한의 교육법체제에 대한 비교를 통하여 내용과 특징 및 법제 통합의 문제점을 파악하고 나아가 교육법제 통합의 방향과 방안을 제시하고자 하였다. 남북한의 통합된 교육법제를 마련하는 것은 통일이라는 이상의 실현을 위해서는 당연히 요청 되는 사안이지만 그 법제 속에 담아야 하는 법의 이념과 목적 그리고 실현하고자 하는 가치 등은 정치체제와 밀접하게 연계되어 있기 때문에 통일한국의 정치체제가 어떠한지 알지를 못하 면서 통합된 교육법제를 제시한다는 것은 참으로 어려운 일다. 남북한 통합교육법제의 교육이념은 우리 헌법이 명시하고 있는 자유민주주의에 근간을 둔 인간의 존엄성과 국민의 기본적 인권의 존중이라는 인류의 보편적 가치를 추구하는 이념이어야 한다. 이러한 보편적인 가치를 추구하는 교육이념을 설정하고 남북한의 교육제도에서 장점으로 기능하는 제도적 특징들을 통합된 교육법제의 내용으로 구비되어야 한다. 교육이 갖는 경쟁적 이고 효율적 측면을 강조한 남한의 학력인정 체제와 북한의 교육복지 사업에 대한 국가적 사회 적 의무와 교육의 실질적 평등실현을 위한 제도적 장치들은 통일된 교육법제에 수용될 가치가 있는 제도들이라고 할 수 있다.
