The crime associated with reconstruction is not limited to yesterday and today. The government attempted to curb the crime repeatedly through revisions of the law and crackdown, but the attempts always ended in failure. Was it because the behavior of the crime so sudden and contingent that it could not be effectively addressed? It was not at all. As revealed by the investigation repeatedly, it was the crime masterminded deliberately by the construction company from the beginning when it was selected for a project in coalescence with maintenance companies, design firms, union executives, and public officials. In the final analysis, the crimes related to reconstruction are structurally so conditioned to be a premeditated crime. If so, would not the crime be curbed if we change that structure? The present research focused on this and studied ways to structurally block crimes at the source. In order to find the cause of the crime, we analyzed various research papers and media press releases that have investigated the crime empirically and, as a result, confirmed that the reconstruction-related crime was structurally inevitable. In other words, crime is triggered by unprofessionalism of union members. This weakness is used by the construction companies for their own benefit, and therefore there is a need for a professional organization to act on behalf of unions that are unprofessional. In addition, it is our belief that if we avoid the union method which is mainly enforced by the unions and the public applicant method and utilize the trust method, in which the promotion committee and unions are omitted, and the public enforcer method, the crime will be reduced. As shown in the case of foreign countries, the governments are planning and controlling the reconstruction projects as public works projects. We believe that when adopting a combination of the trust method, which is not led by the private sector, and the public enforcer method before gradually moving to the public-led public enforcer method, we can also reduce crimes and contribute to the public interest.

재건축과 관련된 범죄는 어제 오늘일이 아니다. 수시로 단속하고 수십 차례 법 개정을 해도 항상 제자리다. 과연 범죄의 행태가 대책을 세울 수 없을 만큼 돌발적이고 우발적이었나? 절대 그렇지는 않다. 이것은 시공사 선정 등을 둘러싼 시공사와 정비업체·설계업체와 조합임원과 공무원들이 유착된 치밀하게 처음부터 계획된 범죄라는 것이 수사 때 마다 밝혀진 사실이다. 결국 재건축 관련범죄는 구조적으로 나올 수밖에 없는 계획된 범죄들인 것이다. 그렇다면 그러한 구조를 바꾸면 줄어들 것이 아닌가? 본 연구는 여기에 주안점을 두고, 범죄의 원인을 찾아 원천 차단할 방법을 위해 그동안 재건축의 범죄를 실증 조사한 여러 논문들과 언론 보도자료 등을 참조하여 분석한 결과 재건축 범죄는 구조적으로 생길 수밖에 없다는 것을 확인하였다. 즉, 조합원들의 비전문성으로 인해 범죄가 유발되고 있다는 것이다. 이것을 시공사들이 자신들의 이익을 위하여 이용하고 있고, 그래서 비전문가인 조합을 대행할 전문가 조직이 필요한 것이다. 또한 조합이 시행을 주도하는 조합방식과 공공지원 방식을 지양하고, 대신 추진위와 조합이 생략된 신탁방식이나 공공 시행자 방식을 활용하면 범죄를 줄어 들이라 생각한다. 그리고 외국사례에 보듯이 각국은 재건축사업을 공익사업이라 보고 정부가 기획하고 통제하고 있다. 우리도 민간주도가 아닌 신탁방식과 공공시행자 방식을 병행하면서 점차 공공이 주도하는 공공시행자 방식으로 갈 때 범죄도 잡고 공익에도 기여할 수 있으리라 본다.
