Multiple public works projects are currently underway in the name of public interest of improvement of living conditions and economic development. However, some raise questions over whether such projects prescribed under the current Korean law sufficiently uphold the public interest and if so, what criteria are to be applied and what the grounds for such criteria are to evaluate the nature of the public interest in such projects. In recognition of such issues, this report looks into the meaning of public nature in respect of the evaluation criteria of the public interest in such public works projects under the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects. Also, the criteria for evaluating the public interest such as requirements. subjects and procedures are compared with the evaluation criteria for the nature of the public interest under the Land Acquisition Act of Japan.

시민생활의 향상ㆍ경제발전이란 공공성의 명제 하에 다수의 공익사업이 추 진되고 있다. 그런데 이 공익사업과 관련해서 현행법에서 정하고 있는 공익 사업의 범주가 과연 공익성이 충분하다고 볼 수 있는 가의 여지를 남겨두고 있으며, 가령 공익성이 있다고 한다면 그 판단할 수 있는 기준은 무엇이며, 이 기준은 무엇을 근거로 하고 있는 가 등등이 있다. 이러한 문제의식 하에 본고에서는 ｢공익사업을 위한 토지 등의 취득 및 보상에 과한 법률(약칭: 토지보상법)｣상 공익사업의 공익성 판단기준과 관련 하여 공공성의 의미에 대해 살펴보고, 그 공공성의 판단기준을 요건, 주체, 절차 그리고 일본의 ｢토지수용법｣상 공공성 판단 기준에 대해 고찰하고, 공 공성 판단기준을 고찰하였다.
