The purpose of this study is to present legislative proposals related to illegal shooting based on the individual experience of camouflage camera dealer and illegal film distributor through in-depth interviews with camouflage camera dealer and illegal film distributor based on previous research. 12 inmates(12 males, 0 females) were interviewed in-depth, including six camouflage camera dealers and six illegal film distributors for this study using the a qualitative research tool Nvivo program. The results of the analysis are as follows. First, both sellers and distributors participating in this study have sold camouflage cameras and illegal footage for economic benefit. Second, both sellers and distributors felt psychological depression about the registration of camouflage cameras and holders and they predicted a decrease in economic profit. Third, both sellers and distributors had vague perceptions about punishment regulations. However, the seller predicted that if legislation was enacted, the sale of camouflage cameras would not be easier than now. Fourth, both sellers and distributors expressed a strong psychological rejection of the punishment of the "Provisions on the Management of Camouflage Cameras" in that they had fines and imprisonment. Camouflaged camera buyers also expressed a strong psychological rejection of having to register. Fifth, illegal film distributors replied that there would be a camouflage camera vendor that was not registered even though registration was enforced. Also people who distribute illegal footage on the job are likely to continue to circulate because there is a way to purchase directly online overseas.

이 연구는 선행연구를 기반으로 위장형카메라 판매자 및 불법촬영물 유포자에 대한 심층적 인터뷰를 통하여 위장형카메라 판매자와 불법촬영물 유포자의 개별적인 경험을 토대로 불법촬영 관련 입법적 제언 을 제시하기 위한 것이다. 이를 위해 위장형카메라 판매자 6명, 불법촬영물 유포자 6명으로 총12명(남 성 12명, 여성 0명)을 심층 면담하였고, 수집된 자료는 질적 연구 도구인 Nvivo 프로그램을 이용하여 분 석하였다. 분석결과는 다음과 같다. 첫째, 이 연구에 참여한 판매자 및 유포자는 모두 위장형카메라와 불 법촬영물을 판매한 경험이 있으며 이는 경제적 이익을 위한 것임을 알게 되었다. 둘째, 판매자와 유포자 모두 위장형 카메라 취급업자 및 소지자 등록에 대하여 심리적 위축감을 느꼈고 이에 따른 경제적 이익 감소를 예측하였다. 셋째, 판매자와 유포자 모두 처벌규정에 대하여 막연한 인식을 가지고 있었다. 그러나 법률이 제정될 경우 판매자는 앞으로 위장형카메라 판매가 지금보다 쉽지 않을 것이라고 전망했다. 넷째, 판매자와 유포자 모두 ｢위장형카메라의 관리에 관한 법률안｣의 처벌에는 벌금형과 징역형이 있다는 것, 위장형카메라 구매자도 등록을 해야한다는 것에 강한 심리적 거부감을 표시하였다. 다섯째, 유포자들은 등록제가 시행되더라고 무등록 위장형카메라 판매업체가 생길 것이라고 응답하였으며, 해외 온라인으로 직접 구매하는 방법이 있으므로 직업적으로 불법촬영물을 유포하는 사람은 지속적으로 유포할 것 같다고 응답했다. 향후 국민이 수용할 만큼의 적절한 판결이 있어야 하겠고, 현재 국회에 계류되어 있는 ｢위장형카메라의 관리에 관한 법률안｣도 다소간의 수정을 거쳐 조속히 제정되어야 하겠다.
