The title of this thesis is ‘The Issue of the Ownership of Aggregate Buildings in North Korea’. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. With rapid economic development and industrialization, the gravitation of the population into cities, the expansion of the nuclear family, and the absolute lack of constructing land have explosively increased demand for condominium including apartment in urban areas. Therefore, the supply of condominium have been accelerated. Such a fact shows that A Korean residence style enter the age of condominium on the full scale. I explained about the main contents of the divided ownership system and suggested especially the problems and improvements in connection with the Ownership of Aggregate Buildings in North Korea.

본고는 북한지역에 소재하고 있는 공동주택과 일반건물 중에서 구분소유권의 객체로 귀속시킬 수 있는 건물의 소유문제를 검토한 것이다. 장래 남북한의 통일과정에서 어떠한 법적 문제가 구체적으로 발생할 것인지를 정확하게 예측 내지 예단하는 것은 일정한 한계가 있다. 그러나 사회질서를 합리적으로 규율할 목적으로 만들어진 것이 법 제도이므로, 그 시행과정에서 불합리한 문제점들이 발생되지 않도록 위험성을 최소화시킬 수 있는 방안들이 지속적으로 모색될 필요가 있다. 특히 구분소유제도는 집합건물을 규율하기 위하여 창출된 제도라는 점에서 종래에 그 특수성을 반영하여 발생한 법적 문제점에 대하여 면밀한 분석을 하게 된다면, 장래 통일한국의 구분소유제도는 보다 합리적이면서 실질적 정의에 부합될 가능성이 높을 것으로 생각한다. 남한의 경우를 살펴보면, 지속적인 경제발전과 인구의 도시집중화로 인하여 공동주택을 포함한 주택의 수요가 급증하게 되었고, 대도시를 중심으로 아파트와 같은 집합건물도 상당할 정도도 증가하게 되었다. 이러한 집합건물의 증가속도에 따라 법적 분쟁도 점진적으로 증가하고 있는 실정이다. 본고는 통일 후 북한지역에서도 자연스럽게 발생할 수 있는 공동주택 및 기타 건물의 소유권 귀속과 관련한 법적 쟁점 중에서 특히 집합건물로의 전환문제 및 구분소유권의 귀속과정에서 발생할 수 있는 몇 가지 법적 문제점에 대하여 검토하였다
