At present, increasing disputes and tense relationships between doctors and patients in China has aroused great attention. According to the statistics in 2016, 20833 cases of medical damages were concluded. In order to better deal with disputes between doctors and patients, it is urgent to establish a multi-dimensional dispute resolution mechanism. The arbitration system has undergone many years of development in China and has been basically mature. The study of combining arbitration with the settlement of doctor-patient disputes is also becoming popular. In 2010, Shenzhen Arbitration Commission established the first Chinese Arbitration Institute for doctor-patient disputes. Over the past few years, more and more doctor-patient disputes have been settled by arbitration in Shenzhen, and a great deal of pressure has been shared by the courts. From 2011 to 2015, a total of 299 cases were filed with Shenzhen Doctor-patient Dispute Arbitration Institute. Especially in 2014, Guangdong provincial court systems handled 1061 cases of medical disputes, and the Shenzhen municipal court system handled 271 cases of medical disputes. At that time, Shenzhen Doctor-patient Dispute Arbitration Institute received 103 cases, more than one third of the cases are handled by Shenzhen court systems. It can be said that up to now, only Shenzhen Doctor-patient Dispute Arbitration Institutein China has typical characteristics, but some problems exposed in it deserve our deep consideration. This article will combine the situation of Shenzhen Doctor-patient Dispute Arbitration Institute to explore the problems existing in China medical arbitration. Whether or not the dispute between doctors and patients is arbitrable in China, and what is its legal basis? The arbitration system for doctor-patient disputes should be established in China. If there is a type of arbitration model similar to that of Shenzhen Doctor-patient Dispute Arbitration Institute, how can the medical and patient sides reach an arbitration agreement better? How to set up the arbitration institution for doctor-patient disputes? After the establishment of the arbitration body for doctor-patient disputes, the selection and training of arbitrators also need detailed provisions. The arbitration rules for doctor-patient disputes should also be separately formulated and relevant rules should be made on procedural matters，such as the composition of the arbitrators, the examination limits, the identification of such matters. There are only eight rules for arbitration of doctor-patient disputes in the Shenzhen arbitration commission. It is also a question of how to charge arbitration fees for medical disputes. The arbitration committees all have their own expert advisory committees, and it remains to be studied whether the arbitration bodies for doctor-patient disputes should also set up special expert advisory committees.

의료분쟁은 일반 민상사분쟁과는 달리 병원과 환자간, 즉, 전문가집단과 비전문가간 의 정보의 비대칭으로 환자의 권리가 보호되기 매우 어려운 구조를 가졌다. 그러므로 기존의 ｢중재법｣으로는 의료분쟁을 중재하기란 매우 어려우며, 새로운 입법을 통하여 의료분쟁을 해결하여야만 한다. 이에 중국은 기존의 민상사분쟁 관련법과 민사소송법 을 기초로 의료분쟁중재에 관한 다양한 법률을 제정하여 이를 해결하려고 노력하였다. 본 연구에서는 중국의 일반 중재에 대한 관련 법률에 대해 살펴보고, 일반 민상사중 재에 있어 어떠한 절차를 가지는지 검토하였다. 이러한 검토는 의료분쟁중재에 있어 응용되기 때문에 매우 중요할 것이며, 한편으로는 중국의 중재시스템에 대한 이해에도 도움이 될 것이다. 이러한 이해를 기초로 2010년 심천에 설립된 심천의료분쟁중재원에 대하여 검토하였다. 중국의 유일한 의료분쟁중재원인 심천의료분쟁중재원에 대한 설 립배경과 운영 등을 검토함으로써 중국 의료분쟁중재의 현주소를 파악할 수 있었다. 또 심천의료분쟁중재원의 현재까지의 중재현황과 성과의 분석을 통하여 다양한 문제 점과 해결방안을 함께 검토하였다. 중국 의료분쟁중재에 대한 이러한 문제점과 해결방안의 검토는 최근 한중 FTA의 체결로 인한 의료서비스 산업의 중국진출로 장래 발생할 수 있는 의료분쟁에 대하여 대처할 수 있을 것이다. 또한, 중국의 심천의료분쟁중재원의 운영상 문제점 등이 한국 의 의료분쟁조정중재원의 운영에 있어서도 다양한 시각에서 시사점으로 제시될 수 있 을 것이라 본다.

近年来，随着医疗需求的急剧增长、医疗机构的迅速扩大、医疗从业人员素质的上 升跟不上需求、医疗负担不断加重、加之民众权利意识的增强，中国医患纠纷颇多，并 呈高增长趋势，医患关系紧张，社会关注度高。医疗纠纷解决方式颇值得研究，目前医 患双方主要选择诉讼解决医患纠纷，据统计，2016年，全国法院共审结医疗损害赔偿案 件20,833件，而医学专家和非专家人员之间存在严重的专业技术信息不对称性，诉讼中 普遍存在的法官医学知识有限、审理期限长、医患双方对抗情绪强等因素，也使得诉讼 这一途径是存在不足，患者权利要得到公平合理的保护是受到现实的技术条件、审判条 件制约的。化解各方矛盾、促进社会和谐，诉讼不应是唯一的、最有效的途径，多元纠 纷解决机制的建立迫在眉睫，而仲裁因其专业技术性、效率性等特点，能有效弥补上诉 诉讼途径的不足，无疑是诉讼之外的重要途径之一。 裁制度在中国经历了多年发展，已基本成熟，将仲裁与医患纠纷的解决相结合的研 究也趋于热门。但是，现有《仲裁法》框架下，仲裁范围局限于平等民事主体之间的合 同纠纷和财产纠纷，对于医患纠纷是否属于可仲裁的范围，在理论和实践中存在比较大 的分歧和质疑，因此有必要通过立法明确。为此,中国以现有的民事纠纷相关法和民事 诉讼法为基础，制定了有关医疗纠纷仲裁的多种法律，以求解决这一问题；也有一些地 方就专门的医疗仲裁进行尝试。 在本研究中，笔者对中国一般民商事仲裁系统的法律、规则、程序、特点等进行研 究，分析整体的仲裁环境和背景，同时，中国深圳设立的深圳医疗纠纷仲裁院的这一先 行性尝试行为进行了探讨，以了解到中国医疗纠纷仲裁的现状，剖析医疗纠纷仲裁院成 立和运营有利经验和暴露的一些问题，提出了相应的解决方案，以期为今后医患纠纷的 解决应对提供启发，特别是对中韩自由贸易协定(FTA)签订后，韩国医疗服务产业进军 中国的过程中提前对问题进行预期及为所遇到的问题，提供更多的解决办法。 本文将结合深圳医患纠纷仲裁院的情况，探析中国医疗仲裁存在的一些问题。比如 医患纠纷是否具有可仲裁性，建立何种模式的医患纠纷仲裁制度，是类似于深圳医患纠 纷仲裁院的选择型模式还是类似于劳动仲裁的强制型模式？每一种模式下需要完善和细 化的内容，每一种模式的优势和面对的问题等等。
