In the recent past, the Korean Coast Guard has undergone various progressive changes and improvements. However, the size of the Korean Coast Guard has reduced as a result of the sinking of the Sewol Ferry; following which the organization was transferred to the National Security Agency. In the context of the current advanced and competitive international maritime capacities, the reduction of the Korea Coast Guard goes contrary to prevailing trends and this can lead to a serious imbalance in national security. Consequently, the Moon Jae-in government revived the Korea Coast Guard in 2017 and returned it to its original position. While the Korean Coast Guard has undergone a number of changes over the years, its functions have also been expanded. However, there is no legal basis for the concept and scope of marine police, which guarantees the most fundamental legal status of the Korean Coast Guard. Although the "Maritime Policing Act" was enacted in 2012 and the role of the Korean Coast Guard officers defined, Maritime Policing Act has several limitations in the launch of the Korea Coast Guard force. On the other hand, many stable laws such as "Police Act" and “Act on the Performance of Duties by Police Officers" have been enacted regarding the land police. But in the case of the Korea Coast Guard, there are no similar laws on “Korea Coast Guard Act” or “Act on the Performance of Duties by Korea Coast Guard”. Therefore, Korean Coast Guard is still legally in a stable position; even though it is inferior to the land police in terms of the statutes. In this paper I briefly review the changes of the Korean Coast Guard and suggest improvements to the problems in the “Maritime Policing Act” and current laws.

그동안 해양경찰은 수많은 변천을 거쳐 지속적인 발전을 거듭하여 왔으나, 2014년세월호 침몰 사고를 계기로 해양경찰은 국민안전처로 이관되어 그 기능이 축소개편되었다. 오늘날 해양세력 경쟁이 가속화 되고 있는 국제정세에 비추어 볼 때 해양경찰의 축소개편은 시대의 흐름에 역행하는 것은 물론, 국가안전과 국민안보에 심각한불균형을 초래하게 되는 것이다. 이에 따라 2017년 문재인 정권이 들어서면서 해양경찰을 부활하여 원래의 위치로돌아오게 되었다. 그동안 해양경찰이 수차례 변화를 겪는 동안 그 기능은 다소 확대되었지만 가장 근본적인 해양경찰의 법적 지위를 보장하는 해양경찰에 대한 개념과직무범위 등에 관한 법적근거가 마련되지 않았다. 비록 2012년에 「해양경비법」이제정되어 해양경찰의 직무를 이에 준한다고 하지만 「해양경비법」만으로는 해양경찰권을 발동하는데 있어서 여러 가지의 미비점이 있다. 이에 반하여 육상경찰의 경우는 「경찰법」을 비롯하여 「경찰관직무집행법」등 수많은 법령들이 제정되어 법적지위가 안정되어 있지만, 해양경찰의 경우는 육상경찰에 준하는 「해양경찰법」, 「해양경찰관직무집행법」 등과 같은 법이 마련되어 있지 않아 해양경찰의 법적 지위가 아직도 불안정한 상태에 있다고 볼 수 있다. 따라서 본 논문에서는 그동안 해양경찰의 변화와 해양경찰의 업무 등에 관하여개괄적으로 점검하고, 「해양경비법」 등 현행 해양경찰의 법제에 관하여 그 문제점 및 개선방안을 도출하였다.
