The purpose of this study is to explore the policies of human rights in other countries and to search for directions for the protection of human rights of migrants. As a result of examining cases of human rights policy in Germany, USA and Canada, Germany recognized the immigration state through the new immigration law and systematically completed the treatment and legal status of migrants. In particular, the social rights of immigrants, such as the right to residence and education, were guaranteed, and they were able to adapt to German society through vocational training education other than school education. Through active affirmative-action, the United States has provided policies that favor the politically marginalized and discriminated groups so that they could exercise and participate in equal rights of immigrants. Canada introduced the Immigration and Refugees Protection Act to ensure the independent immigration of professional manpower and to enforce the entry permit system for refugees as well as family reunion. In Korea, the National Human Rights Policy Basic Plan is formulated every five years and the Migrants' Human Rights Guidelines are established. it is to strengthen national solidarity by enhancing the quality of life and human rights of immigrants. Nevertheless, it is still necessary to protect the human rights of people in the blind spot of human rights. Therefore, this study suggests the directions for the protection of migrants' human rights.

본 연구의 목적은 국내 외 인권정책을 탐색하고 이주민들의 인권보호에 대한 방향을모색하는 것이다. 이를 위해 독일과 미국, 캐나다의 인권정책 사례를 살펴본 결과 독일은 신 이민법을 통하여 이민국가를 인정하고 이주민의 처우와 법적 지위를 체계적으로완성하고 있었다. 특히 이주민들의 사회적 권리인 거주권과 교육권을 보장하고 학교교육 이외의 직업양성교육을 통하여 독일 사회에 적응할 수 있도록 하였다. 미국은 적극적차별시정조치를 통하여 정치적으로 소외되고 차별받는 집단을 우대하는 시책을 마련하여 이주민들의 동등한 권리를 행사하고 동참할 수 있도록 하였다. 캐나다는 이민 및 난민보호법을 도입하여 전문 인력의 독립이주를 보장하였고 가족재결합은 물론 난민을 위한 입국허가제를 시행하여 이민자 통합정책을 실시하였다. 국내의 경우 국가인권정책기본계획을 5년 마다 수립하여 이주인권가이드라인을 정하여 이민자들의 삶의 질 및 인권의 향상을 통해 국가결속력을 강화하려고 노력하고 있다. 그럼에도 불구하고 아직까지 인권의 사각지대에 있는 사람들의 인권보호가 필요한 실정이다. 이에 본 연구에서는이주민의 인권보호를 위해 나아가야 할 방향을 제시하였다.
