The purpose of this study is to review the transition of Law-Related Education(LRE) in Korean elementary social studies. In order to achieve this purpose, law-related contents in elementary school textbooks for the 4th, 5th, and 6th grade since 1946 were analyzed. For having a clear grasp of characteristics of LRE by the curriculum period, it was examined and compared how to be gave a description of the law-related theme -human dignity- that has appeared in textbooks for all periods of curriculum. The criteria of comparison and analysis were established by the legal reasoning mode which was constructed by deductive reasoning, analogy, inductive reasoning, and dialectical reasoning. Because the legal reasoning mode is a structure related with the legal norm and case that are based on contents for LRE. The major results from this study are as follows. First, LRE of elementary social studies in Korea was centered on legal norms and public law. Second, it was proceeding from legal norms-centered to cases-centered. But, the legal reasoning mode was restricted within the deductive reasoning or the inductive reasoning. For developing LRE of elementary social studies in Korea, we must make law-related contents learner-centered, story-centered, and Korean cases-centered.

본 연구에서는 한국 사회과에서 법교육의 변천 모습을 살펴보고자 하였다. 이를 위해 초등학교 사회과 교과서의 법 관련 내용의 분석을 시도하였으며, 교수요목기부터 제7차 교육과정기에 이르기까지 초등학교 사회과 456학년 교과서의 법 관련 내용을 분석의 대상으로 하였다. 각 교육과정기별 법교육의 특성 파악을 위하여 전 교육과정기 동안 지속적으로 등장한 주제들을 검토하고, 그 중에서 ‘인간의 존엄성’에 대한 기술을 문맥 단위로 비교분석하였다. 비교분석의 기준은 법교육 내용의 기반이 되는 법규범과 사실의 관련 구조인 법적 추론 방식을 중심으로 설정하였다. 본 연구를 통하여 나타난 한국 사회과에서의 법교육의 변천 경향은 첫째, 전반적으로 법규범 중심 또는 공법 중심적인 틀 속에서 내용이 구성되어 있었다. 둘째, 교육과정기를 거쳐 오면서 점차 법규범 중심에서 사실 및 사례 중심으로 나아가고 있으며, 법적 추론 방식은 연역적 추론 방식에서 귀납적 추론 방식으로 나아가고 있었다. 이상의 변천 과정에서 시사 받는 바는 법규범 중심에서 사례 중심으로 나아가되, 공법보다는 사법 및 학습자 중심의 내용 구성, 단편적인 사례가 아닌 이야기 중심의 내용 진술, 그리고 외국의 사례가 아닌 한국의 대표적인 사례의 제시로 나아갈 필요가 있다고 본다.
