Recently, in Korea, violence among lovers, murder caused by 'date violence' has been emerging as a social problem. Therefore, the NPA organized a special team and operated the report period intensively. However, it is pointed out that the low reporting rate due to the peculiarity of the lover relationship and the passive response of the investigation agency to the severity of the damage ultimately affect the development of the violent crime. A special law for effective measures against dating violence was enacted in Japan. This is not an independent law, but is expanding the range of target. Domestic Violence Disclosure Scheme(DVDS) supports disclosure of criminal records of the potential assailant to the potential victim in a dating relationship and can be used as an effective way to prevent date crime. In order to prepare more effective countermeasures, the introduction of the Claire Act of England is being promoted. However, there is still a heated debate on privacy violations and conflicts with other laws. Therefore, this study examines the major issues and implications surrounding the introduction of the Clare Law and looks at ways to improve policing policies. A change in the police official’s awareness through prevention and education about the seriousness of dating violence crime are required, also action to ensure the safety of the victim, etc. establish a legal framework will be necessary to make positive response of law enforcement agencies.

최근 한국에서는 연인 간의 폭력, 일명 ‘데이트 폭력’ 으로 인한 살인 사건이 발생하는 등 개인 차원의 문제를 넘어 사회적 화두로 떠오르고 있다. 이에 경찰청에서는 특별팀을 구성하고 집중적 으로 신고 기간을 운영한 바 있다. 하지만 연인 관계의 특수성으로 인해 낮은 신고율과 피해의 심각성에 대한 수사기관의 소극적인 대응이 결국 강력 범죄로의 발전에 영향을 미치고 있다는 지 적이 있다. 일본에서는 데이트폭력의 심각성에 대한 사회적 공감대 반영의 차원에서 특례법 영역으로 이 를 규제하기에 이르렀다. 독립적인 특례법은 아니지만 기존의 법 테두리 밖에 있었던 데이트 폭 력을 적용 대상으로 확대한 것으로 볼 수 있다. 영국에서도 일명 ‘클레어법’을 도입하여 파트너의 과거 폭력 전과를 조회할 수 있게 되었다. 이에 우리나라에서도 데이트폭력에 대한 효과적인 대 책방안으로 영국의 ‘클레어법’ 도입에 대한 관심이 집중되고 있으며, 지난 대선 후보의 공약으로 까지 제안된 바 있다. 하지만 개인정보 침해, 타 법률과의 충돌 등의 문제로 인해 여전히 뜨거운 논쟁중이다. 따라서 이 연구에서는 데이트폭력의 실태를 살피고, 일본과 영국의 관련 법률의 주요 내용을 고찰하였다. 그리고 경찰의 적극적인 대응과 현장대응력 강화를 위한 관련법 개선의 필요성과 인 식개선을 위한 교육훈련을 제언하고자 한다.
