In this study, after the adoption of the United Nations Convention on the Rights of Persons with Disabilities in 2006 and the establishment of the Anti-Discrimination against and Remedies for Persons with Disabilities Act in 2007, In order to establish the effective settlement of the Education System for the promotion of disability awareness, it is tried to suggest a legal improvement plan by closely examining the cases of other disciplines and relevant researches on the progress of the introduction of he Education System for the promotion of disability awareness into the related law and the efforts to improve the system after the introduction. The revision of the Disabled Welfare Act and Promotion of Employment and Vocational Rehabilitation of Disabed Persons Act in 2007 first introduced the Education System for the promotion of disability awareness. In accordance with the revision of the Disabled Welfare Act in 2015 and the revision of promotion of Employment and Vocational Rehabilitation of Disabed Persons Act in 2017, It has expanded to include employees and students from national and local governments Child-Care Centers, kindergartens, elementary and junior high schools, universities, public institutions and employers. However, in order to effectively establish the Education System for the promotion of disability awareness, it is necessary for the private institute such as medical institutions, welfare facilities, physical education facilities, vocational training institutions and lifelong education facilities that are obliged to prohibit discrimination and legitimate accommodations pursuant to the Anti-Discrimination against and Remedies for Persons with Disabilities Act, In addition, it is necessary to improve the legal system including the inspection system for the report on the results of the implementation of the training on the Disabled Welfare Act, which stipulates most of the compulsory education subjects excluding the employer, the compulsory enforcement means, and the designation of a dedicated institution for training institutions and instructor training

본 연구는 2006년 UN 장애인 권리협약 채택과 2007년 장애인차별금지 및 구제 에 관한 법률 제정에 따라 장애인 권리증진과 차별금지의 제도적 기반이 조성된 이후 이의 효과적인 정착을 위하여 장애 인식개선 교육제도가 관련 법률에 도입된 경과와 도입 이후의 제도개선 노력 및 아직도 미흡한 부분에 대하여 타법사례 및 관련 연구를 면밀히 분석하여 법적개선 방안을 제시하고자 한다. 2007년 장애인복지법 및 장애인고용촉진 및 직업재활법 개정에 따라 장애 인식 개선 제도가 처음 도입 되었으며, 2015년 장애인복지법 개정과 2017년 장애인고용 촉진 및 직업재활법 개정에 따라 교육대상이 국가와 지방자치단체, 어린이집, 유치 원, 초중고, 대학교, 공공기관 및 사업주 등의 소속직원 및 학생으로까지 확대되었 다. 그러나 장애 인식개선 교육제도의 효과적 정착을 위해서는 장애인차별금지 및 구 제에 관한 법률 에 따라 차별금지와 정당한 편의제공 의무가 있는 의료기관, 복지시 설, 체육시설, 직업교육훈련기관 및 평생교육시설 등 민간기관까지 확대가 필요하다. 또한 사업주 외 대부분 의무교육 대상에 대하여 규정하고 있는 장애인복지법 에 대하여 교육실시 결과보고에 대한 점검체계 구비, 의무이행 강제수단 구비, 교육기 관 및 강사양성 관리를 위한 전담기관 지정 등 법적개선이 필요하다.
