In the 21th century the information technology resulted in change from analog to the digital era, and digital innovation has brought a lot changes of economy, industry, culture and so on to our society. Such changes have occurred in the area of intellectual property as well. In the digital era anyone can, only if he wants, easily reproduce the intellectual products of others without any efforts with using digital technology. The developed countries in the intellectual property area have made legal regulation and policy to strengthen or enlarge intellectual property rights, ie. pro-IP policy. Upon this pro-IP policy the rights of owners on their intellectual products have been more strengthening. Under these circumstances, it is, however, still questionable on how further the scope as well as terms for protection of intellectual property rights should be enlarged. On this account, the issue on justification of intellectual property rights in the digital era till needs to be discussed. This study is mainly focused on nature law, utilitarianism, neoliberal economics, democratic paradigm and distributive justice from the viewpoint of legal philosophy, legal history and economics. These theories suggest any grounds for their arguments in their own ways, however, it seems to be difficult for one of them to clearly present grounds for arguments on justification of intellectual property rights in the digital era. On the contrary, these grounds for arguments eventually could be applied in parallel. The study on justification of intellectual property rights are concerned with the issue on how democratic society should be achieved, and how immaterial intellectual products should be justly distributed to the development of our society. Hopefully this issue needs to be more actively discussed in the area of intellectual property in the digital era.

21세기는 정보화 시대를 맞이하여 아날로그에서 디지털 시대로의 변화를 초래하였고, 디지털 혁명은 우리 사회에 경제, 산업, 문화 등 많은 변화를 가져왔다. 지식재산 분야 역시 예외는 아니다. 디지털 시대에 누구든지 인터넷에서 디지털 기술을 활용하여 타인의 지적산물을 아무 노력 없이 손쉽게 복제하여 사용하거나 편승하는 행위가 꾸준히 일어나고 있고, 이에 대하여 지식재산 선진국들은 법제 또는 정책적 변화를 통해 지식재산 보유자의 권리를 강화하는 소위 Pro-IP 정책을 전개하여 왔다. 이러한 정책을 통해 권리자들의 권리는 더욱 강화 또는 확대되어 왔으며, 지식재산 객체의 외연은 계속 팽창되어 왔다. 이러한 가운데 디지털 시대에서 지식재산 보유자에게 그 보호대상에 대한 보호범위나 보호기간의 최적은 어느 정도인지에 대한 논의를 포함하여, 지식재산의 정당성 논거에 관한 다양한 관점들이 제시되고 있다. 본 연구에서는 지식재산의 정당성 문제를 자연법적, 공리주의, 신자유주의 경제이론, 민주주의 패러다임 및 배분적 정의이론에 대하여 법철학, 법제사 및 법경제학적 관점에서 고찰하였고 비판적 견해를 제시하였다. 이러한 논거들은 다양한 관점에서 주장하고 있는데, 어느 하나의 논거가 지식재산의 정당성을 명확하게 설명하고 있다고 볼 수는 없다. 오히려 각 이론들이 실질적으로 병렬로 나란히 적용될 수 있다고 생각한다. 지식재산의 정당성에 관한 연구는 그동안 주로 권리자와 이용자 관점에서 바라보아 왔는데, 최근 서구에서 신자유주의 경제이론, 민주주의 패러다임 또는 배분적 정의라는 관점에서 지식재산의 정당성에 대한 논거를 모색하고 있다는 점에 착안하여 본 연구에서는 이들을 소개하고 분석 및 비판하였다. 향후 지식재산 연구자들이 지식재산권의 정당성의 논거에 관해 더욱 지대한 관심을 가지고 더욱 활발하게 후속 연구를 해 나가야 할 것이라고 생각한다.
