Laos is a socialist country with China and Vietnam, but also a transition country that introduced a market economy. Before and after joining the World Trade Organization in 2013, the legal reform was promoted rapidly in Laos with the aim of creating an environment suitable for the market economy, leading to the expansion of foreign investment attraction. The increase in foreign investment is considered to have played a large part in Laos' steady economic growth compared with the surrounding Southeast Asian countries. Laos has been pursuing specific policies aimed at breaking the status of least developed countries by 2020. Above all, the relevant legal system has been continuously improved in order to actively attract and expand foreign investment. Laos has revised its existing investment law in line with global standards in December 2016 and has been in operation since April 2017. However, since Laos still chooses socialism politically, it is limited to understand the Lao legal system by simply analyzing the law without understanding the rule of law in Laos. In this study, first of all, I will examine what the concept of the law of Laos is as a socialist state, what kind of characteristics it is, and how the level of the Laotian rule of law is compared with other Southeast Asian countries. Then I will examine the development process of the Lao Investment Legislation. In particular, the purpose, composition and main contents of the revised Lao Investment Law will be compared with the Lao Investment Law of 2009. In conclusion, I would like to draw some prospects and implications for Korea.

라오스는 중국, 베트남과 함께 사회주의국가이면서도 경제부문에서 시장경제를 도입한 대표적인 체제전환국가이다. 2013년 세계무역기구 가입을 전후하여, 라오스에서는 시장경제체제에 적합한 환경조성을 목적으로 제도개혁이 빠르게 이루어졌고, 이는 외국인투자유치 확대로 이어졌다. 라오스가 주변 동남아시아 국가들에 비해 안정적인 경제성장을 지속하는 데에는 이러한 외국인 투자의 증가가 큰 역할을 한 것으로 평가 되고 있다. 라오스는 2020년까지 최빈개도국 지위를 탈피하는 것을 목표로 구체적인 정책을 추진해 왔다. 무엇보다 외국인투자를 적극적으로 유치․확대하고자, 관련 법제도를 지속 적으로 정비해 왔다. 라오스는 2016년 12월, 글로벌 스탠다드에 맞추어 투자법 개정을 단행하였고, 2017년 4월부터 시행 중에 있다. 그런데 라오스는 여전히 정치적으로는 사회주의를 택하고 있기 때문에, 라오스 특유의 법치에 대한 이해 없이, 단순한 법규의 분석만으로는 라오스 법제도를 이해하는데 한계가 있다. 따라서 본 연구에서는 먼저, 사회적 자본으로서의 법치주의의 역할에 주목하면서, 사회주의 국가로서 라오스의 법치의 개념은 무엇이며 어떤 특징이 있는지, 또한 라오스 법치주의의 수준이 다른 동남아시아 국가들과 비교하여 어떠한지 살펴보고, 이를 기초로 하여, 라오스 투자법제의 발전과정을 고찰하고자 한다. 특히, 개정 라오스투자 법의 목적, 구성 및 주요내용을 기존 2009년 라오스투자법과 비교하여 분석하며, 결론 적으로 향후 전망과 한국에의 시사점을 도출하고자 한다.
