Korea has also entered an aged society and is expected to become a super-aged society as the average life span is extended due to advanced medical technology and improved quality of life. The main issue of this paper is to improve the housing welfare legislation of the elderly, such as the legislation for housing support, the establishment of customized housing design standards for the elderly, the improvement and expansion of convenient facilities in which the existing elderly people live, and the establishment of new design standards such as public facilities. Currently, our residential facilities for the elderly are limited to general housing and nursing homes, and there is a need to expand the supply of senior housing that can allow independent residence and combined welfare of nursing, medical care and shopping. The law and institutional support for this should be fundamentally laid for the welfare of the elderly. In the case of collective housing facilities, it is necessary to clarify the legal rights and obligations for the elderly residing in the facility, and legislative measures should also be taken to prevent the infringement of the rights of the elderly. This study suggested that there is a need to provide communal housing for the elderly with all the convenient facilities necessary for the elderly's life in a residential space, such as a complex shopping mall that is popular in shopping these days, and presented a legislative alternative for laying the legal foundation. It is hoped that this study will be useful for providing institutional support to realize housing welfare where the elderly live in a convenient and comfortable residential environment.

우리나라도 의료기술의 발전과 삶의 질 향상으로 평균수명이 연장되어 고령사회로 진입하여 초고령사회를 앞두고 있다. 본 논문의 주된 쟁점인 고령자의 주거복지법제에 관한 개선방안은 주거지원에 관한 법안 마련, 고령자를 위한 맞춤형 주택설계기준 마련, 기존 고령자가 거주하는 주거의 편의시설 정비 및 확충, 공공시설 등 신축 설계기준 정비 등을 통한 것 등으로 요약할 수 있다. 현재 우리의 고령자를 위한 주거시설은 일반주택과 요양시설에 한정되어 있으며 독립적인 주거가 가능하고 요양․의료․쇼핑 등의 복지가 융합된 고령자전용주택의 공급확대가 이루어져야 할 필요성이 있다. 이를 위한 법과 제도적 뒷받침이 마련되어야 고령자를 위한 주거복지라고 생각된다. 집단주거시설의 경우에는 입주하는 고령자를 위해서 법적 권리의무관계를 명확히 할 필요성이 있으며, 고령자의 권리침해를 방지하기 위한 입법론적 방안도 강구되어야 할 것이다. 논문은 고령자를 위한 주택으로 요즈음 쇼핑에서 각광받고 있는 복합쇼핑몰처럼 주거공간에서 노인의 삶에 필요한 편의시설을 모두 공동주택에 두어 서비스를 제공할 필요성이 있음을 제기하였으며, 이를 위한 법률적 근거마련을 위한 입법론적 대안으로 제시하였다. 본고는 고령자가 편리하고 쾌적한 주거환경에 생활할 수 있는 주거복지를 실현하기 위해 법제도적 뒷받침을 위한 참고가 되었으면 한다.
