It is an international trend that such environmental crimes as environmental destruction and damage are considered as anti-social actions of ruining human’s lives, bodies and health, which is beyond its recognition that they are just environmental violations. So far those environmental destruction and damage has been understood to be inevitable for high-tech industry, which has led to some light punishment for those crimes. However, as both domestic and international cognition on environment gets higher, the environmental judicial power over environmental crimes is getting strengthened. Accordingly, this study has developed plans to better understand the current status of the Special Judicial Police for Environmental Protection and the foreign cases so that improvement plans might be drawn up for its quick action and efficient operation. This study has been carried out so that those environmental crimes, which are getting more intellectual, more global and more serious along with advancing societies, may be coped with more efficiently on the foundation established through the special police’s expertise on environmental affairs, its professionalism at investigation and organic cooperation among environmental agencies and institutions to local governments.

최근 국제적인 흐름은 환경에 대한 파괴, 훼손, 등 환경범죄에 대한 단순한 환경 위반사범이라는 인식을 넘어 모든 인간의 생명과 신체 및 건강을 침해하는 반사회적 행위로 간주되고 있다. 그 동안 첨단산업화로 인한 환경파괴 및 범죄 행위는 필수 불 가결한 요인으로 인지되어 형사사범에 비해 그 처벌이 가벼웠다. 그러나 환경에 대 한 국제적·국내적 인식이 높아지면서 환경 파괴행위에 대한 환경사법이 강화되고 있다. 이에 본 연구에서는 환경특별사법경찰의 환경사범에 대한 신속한 대처와 효율 적 운영을 위한 개선 방안으로 환경특별사법경찰의 현황과 외국사례를 통해 개선해 야 할 몇 가지를 방안을 논하고자 한다. 환경특별사법경찰의 환경업무에 대한 전문 성, 수사분야의 전문성, 환경관련기관의 유기적 협력 및 거버넌스적 (Governance) 지역협력체를 통해 환경관리체계 구축을 기반으로 사회발전에 따라 지능적, 광역적, 신숙하게 점차 증가하고 있는 환경범죄에 효율적으로 대처하고자 한다.

    우리나라에는 전국 대학에 경찰행정학과가 130여개나 된다. 전국 경찰관의 숫자도 10만 3000여명이 넘어서고 있으나 아직까지 경찰관들의 순직과 공상문제를 심층연구하는 학회가 존재하지 않고 있다. 매년 경찰공상자의 수사 1500여명을 넘어서고 있으나 이에 대한 제도적 논의조차도 나오지 못하고 있는 실정이라 이에 대한 본격적인 학문 연구가 시급한 실정이므로 이에 관련 분야들을 집중적으로 연구하여 경찰행정 분야의 학문발전에 더 한층 기여하는데 본 학회의 설립목적을 두고 있다.
