The title of this thesis is ‘Legal Issues in connection with the Management of Aggregate Buildings’. It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. With rapid economic development and industrialization, the gravitation of the population into cities, the expansion of the nuclear family, and the absolute lack of constructing land have explosively increased demand for condominium including apartment in urban areas. Therefore, the supply of condominium have been accelerated. Such a fact shows that A Korean residence style enter the age of condominium on the full scale. I explained about the main contents of the divided ownership system and suggested especially the problems and improvements in connection with the management of aggregate buildings.

이 논문은 그 제목을 집합건물의 관리와 관련한 몇 가지 법적 문제라고 정하였다. 장래에 어떠한 법적 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측하는 것은 일정한 한계가 있다. 그러나 사회질서를 규율할 목적으로 만들어진 것이 법 제도이므로, 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 방안들이 꾸준하게 모색될 필요가 있다. 특히 구분소유제도는 새롭게 창출된 제도라는 점에서 종래에 발생한 문제점들을 면밀하게 파악한다면, 장래에 정립될 구분소유제도는 조금 더 합리적이고 실질적 정의에 합치될 가능성이 높다. 이와 관련하여 우리나라의 경우에는 1960년대부터 경제발전과 인구의 도시집중으로 인하여 주택수요가 급증하게 되었고, 이를 원인으로 대도시를 중심으로 아파트 등과 같은 집합건물이 증가하였다. 그 결과 건물을 계층적으로 구분하여 소유하는 것이 일반화되고 있으며, 이에 관한 법적 분쟁도 증가하고 있는 실정이다. 이러한 이유에서 본고는 집합건물과 관련한 법적 쟁점 중에서 특히 집합건물 및 공동주택의 관리와 관련하여 발생하고 있는 법적 문제점을 중심으로 관련쟁점과 그 개선방향을 검토하였다.
