As Korean companies' technological competitiveness has become global, the technology leakage cases of overseas expansion businesses are growing. The 64% of all technology spills are occurring in small businesses. Although the technology level of small businesses has improved a lot, it is easy to leak industrial technology. Especially, in the case of Korea's overseas expansion businesses, human and physical security infrastructure is very poor. Therefore, the companies with core technologies should review the improvement plan related to industrial technology protection to support by legal system and support plan to prevent prevent technology leakage. This study analyzed the current state and real condition of technology outflows of overseas expansion enterprises, and examined the legal system and support policies to prevent foreign technology outflows, and found problems and suggested ways to improve them. To protect the technology of overseas expansion businesses, the points to organize at government level are explaining and expanding consultation on the local laws related to companies, understanding difficulties of the damage on technology leakage, companies visit, and industrial security, conducting a leak investigation jointly with companies and expanding diplomatic resolution efforts are necessary. In particular, small businesses with core technologies need to expand their support to build security systems to prevent technology leakage. The laws related to prevention and protection of industrial technology leakage are established and operated to prevent the technology leakage of overseas expansion businesses. However, the subject of protection and support is limited by core technology, high technology, new technology, and electrical power technology on high tech industrial technology. In terms of technology protection for small businesses, the Act on the Protection of small businesses' Technical Protection provides for the establishment of a penalty clause and the provision of industrial security control services, but a broader legal basis should be established. To prevent the leakage of industrial technology, It is necessary to discuss the establishment of the basic law on the protection of industrial technology to support it institutionally with the establishment of a control tower structure that can systematically and efficiently coordinate industrial technology protection policies, the establishment of a dedicated department and the United States' Bureau of Industry and Security (BIS).

우리나라 기업들의 기술경쟁력이 세계적인 수준으로 올라서면서 해외진출기업의 기술유출 사례가 늘어나고 있다. 전체 기술유출 사고 중 64%가 중소기업에서 발생하고 있다. 우리나라 중소기업들의 기술수준이 그동안 많이 발전한 점도 있지만, 그만큼 산업기술을 유출하기가 쉽다는 점도 있다. 더욱이 최근 기술유출 수법이 날이 갈수록 교묘해지면서 기술을 개발하는 것만큼이나 기술유출을 지키는 것도 중요하다. 특히 해외진출기업의 경우 인적･물적 보안인프라가 매우 열악하기 때문에 핵심기술을 보유한 기업에게 기술유출 방지를 위한 지원방안과 법제도적으로 뒷받침하기 위한 산업기술보호관련 법제도적인 개선방안에 대한 검토가 필요하다. 본 연구에서는 해외진출기업의 기술유출 일반현황과 실태를 분석하고, 해외기술유출 방지를 위한 법제도･지원정책을 검토하여 문제점을 도출하고 개선방안을 제시하였다. 해외진출기업의 기술보호를 위해 정부차원에서 추진해야 할 점으로는 기업에 대한 현지 관련 법률 설명･자문확대, 현지 기술유출 피해 및 기업방문 산업보안 애로사항 파악, 기업대상 기술보호 설명회 해외 현지 개최 확대, 기밀유출 시 기업과 공동으로 유출조사 실시, 외교적 해결노력 확대 등이 필요한 것으로 보인다. 특히 핵심기술을 보유한 중소기업에게는 기술유출 방지를 위한 보안시스템구축 지원을 우선적으로 지원을 확대해야 할 필요가 있다. 해외진출기업의 기술유출 방지를 위해 산업기술의 유출방지 및 보호에 관한 법률 등이 제정 ･운영되고 있으나, 보호･지원 대상이 첨단 산업기술에 대해 국가 핵심기술, 첨단기술, 신기술, 전력기술 등에 한정되고 있다. 중소기업의 기술보호라는 측면에서는 「중소기업기술 보호 지원에 관한 법률」에 처벌조항의 정비, 산업보안관제 서비스에 대한 점을 정하고 있지만 좀 더 폭넓은 법적 근거를 마련하여야 한다. 산업기술의 유출을 방지하기 위해서는 정부 내에 전담부서의 신설과 함께 미국의 산업보안국(BIS)과 같이 산업기술보호 정책을 체계적이고 효율적으로 조율할 수 있는 범정부적 컨트롤 타워 조직의 설치와 함께 이를 제도적으로 뒷받침하기 위한 산업기술보호관련 기본법 제정에 대한 논의가 필요하다.
