The purpose of this paper is to review the actual conditions of lawful reactions against cyber terrorism that has been severely influencing on the entire nation and society due to the development of information communication technology and diffusion of Internet in Korea and abroad and to suggest measures to reinforce the legal capacity to fight against cyber terrorism in Korea in the future. For this, it was intended to secure clarity in cyber terrorism through the analysis of definition, characteristics, and types of cyber terrorism as the fundamental theory in discussion of cyber terrorism and to identify implications of laws in Korea by comparing and reviewing the actual conditions of lawful reactions against cyber terrorism in Korea and abroad. In the conclusion, several plans are suggested to reinforce legal capacity to fight against cyber terrorism in the future. According to the results of research, there were many problems in effectively preventing and regulating cyber terrorism as related regulations in coping with cyber terrorism in Korea turned out to be dispersed into various legislations instead of belonging to one particular piece of legislation. As for measures to solve such problems, this study has suggested unification of legislation related to cyber terrorism, reinforcement of proactive and preventive functions against cyber terrorism, modification of legislation in accordance with changes in the trend of the spread of cyber terrorism, establishment of cooperation system between government bodies and private sectors, consolidation of international cooperation, etc.

이 논문은 오늘날 국내외적으로 정보통신기술의 발달과 인터넷의 확산으로 인해 국가와 사회전체에 심각한 영향을 주고 있는 사이버테러에 대한 국내외의 법적 대응실태를 검토하여 향후 법제적 차원에서 우리나라 사이버 테러 대응역량을 강화할 수 있는 방안을 제시하는 데 그 목적이 있다. 이를 위하여 우선 사이버테러의 논의에 있어서 기본적 이론인 사이버테러의 정의, 특성 및 유형의 분석을 통하여 사이버테러에 대한 명확성을 확보하고자 하였으며, 이어서 사이버테러에 대한 국내외의 법적 대응실태를 비교ㆍ검토하여 우리 법제에 대한 시사점을 파악하고자 하였고, 결론부문에서는 향후 사이버테러에 대한 법제적 대응역량의 강화를 위한 몇 가지 방안을 제시하였다. 연구결과, 현재 우리나라의 사이버테러 대응 법제는 관련 규정이 단일 법령에 속해 있는 것이 아니라 여러 법령에 분산되어 있어서 사이버테러를 효과적으로 예방ㆍ규제하는데 많은 문제점이 있음이 드러났다. 이러한 문제점에 대한 개선방안으로, 사이버테러 관련 법령의 단일화, 사이버테러에 대한 사전적 예방기능의 강화, 사이버테러 양상변화에 맞는 법령정비, 정부기관 간 및 민관 공조체제 구축, 국제협력 강화 등을 제시하였다.
