Recently the police organization has faced the domestic and international changes; the rapid society changes and increasing desires of various civil human right. So social asks for the quality-improvement of the procedure of investigation have been increasing and various ways for satisfying their needs have been focused. In connection with this situation, the academic world has been interested in the minor offense screening committee to guarantee appropriateness of investigation. The police invited citizens and formed the minor offense screening committee that decides which offender should go to summary trial or be dismissed on warning. Therefore the purpose of this study is to analyze present condition and problem of minor offense screening committee. Consequently this study will offer effective ways to guarantee human right. As the result above study, we discuss preparing legal basis for regularization of minor offense screening committee and relief for human right guaranteeing of suspect and the accused as managing and administrating effectively. Also we suggest prior action for rationalization of minor offense screening committee and guaranteeing autonomy between the parties with respect to minor offense screening committee. On the basis of above study result, this study suggested some necessary ideas on managing and administrating the minor offense screening committee effectively in the future.

최근 경찰 조직은 사회의 급속한 경제성장, 다양한 시민인권에 대한 요구 증가 등 다양한 대내ㆍ대외적 변화에 직면하고 있다. 이에 경찰 수사절차의 질적 향상에 대한 사회적 요구가 늘어나고 있으며, 시민의 요구를 충족하기 위한 다각적 노력이 강조되고 있다. 이와 관련하여 수사단계의 적정성을 보장할 수 있는 수단의 하나로서 학계에서는 경미범죄 심사위원회에 대한 관심이 높아지고 있다. 경찰은 일선 경찰서에 시민이 참여하는 ‘경미범죄 심사위원회’를 구성하고, 정상 참작의 여지가 있는 가벼운 범죄에 대해서는 즉결심판 청구나 훈방 등으로 처분을 감경하도록 하고 있다. 따라서 이 연구는 경미범죄 심사위원회의 현황과 문제점을 분석하여, 시민의 인권을 보장할 수 있는 효율적 방안을 제시하고자 하였다. 분석 결과, 경미범죄 심사위원회의 효율적 운영방안으로서 경미범죄 심사위원회의 정례화를 위한 법적 근거 마련, 피의자 및 피고인의 인권보호를 위한 구제권 마련 등을 논의하였고, 경미범죄 심사위원회의 적정화를 위한 사전조치 마련과 경미범죄 당사자 간의 자율성 보장을 제시하였다. 이 연구에서는 이러한 연구결과에 근거하여 향후 경미범죄 심사위원회의 운영과 관리방안에 필요한 제언을 제시하였다.
