This study aims to conduct a comparative analysis between the Disability Discrimination Acts of Korea and Japan, which are enacted on the basis of the social model of the country. The study was performed by analyzing the Acts of both countries by focusing on the core articles of the Acts, and by comparing the level at which the Acts take the perspective of social creationism versus constructionism in the social model. As a result of the analysis of the Disability Discrimination Act in both countries based on the social model, it was found that the largest portion of the Korean Act has been social creationism, whereas the comprehensive social model that exists in Japan has resulted in both social creationism and constructionism being presented together. As a result of the study, this paper suggests the following for the development of the Disability Discrimination Act in Korea in future: First, a solution has to be found to address the discordance with the country’s social model. Second, the portion of the Act relating to the social constructionism of the social model has to be expanded. Third, it has to accumulate cases of individual reasonable accommodation, but at the same time, prevent it from being an individual model. Forth, those Acts relating to disability have to be amended on the basis of the social model.

본 연구의 목적은 사회모델을 기반으로 제정된 한국의 장애인차별금지법과 일본의 장해자차별해소법을 비교분석하는데 있다. 이러한 연구목적을 달성하기 위해 양국의 법률을 중요조항을 중심으로 비교분석하고, 사회모델 중 사회창조주의와 사회구성주의 관점의 정도를 비교하였다. 양국의 장애인차별금지법을 분석한 결과 가장 많은 유형을 차지한 것은 한국은 사회창조주의였으며, 일본은 사회창조주의와 사회구성주의가 함께 나타난 포괄적 사회모델이었다. 이러한 연구결과를 통해 향후 한국장애인차별금지법의 발전을 위한 제언을 다음과 같이 하였다. 첫째 사회모델과의 부조화를 해결하여야 한다. 둘째 사회모델 중 사회구성주의 부분을 확대시켜야 한다. 셋째 정당한 편의제공에 대한 사례를 많이 축적하여 개별모델로 빠질 수 있는 여지를 두지 말아야 한다. 넷째, 장애인복지 관련 법들을 사회모델에 근거하여 개정할 필요가 있다.
