Extrapolating from prior studies and theoretical models explaining legitimacy, this study examines factors and sources of correctional officers legitimacy among male inmates. More specifically, this study hypothesizes difference in how correctional officers, power holders, exsert their power on inmates, recipients, may result in difference on inmate’s perception of correctional officers legitimacy. Given the arguments regarding the cultivations of legitimacy in prisons from prior literatures, this study assumes procedural and distributive justice have impact on the total legitimacy. Using 213 male inmates survey data, the findings of this study consistent with prior studies findings and found supportive evidences for theorematical augments on legitimacy. Especially, it revealed that the perceptions of inmates procedural justice from interactions with correctional officers has greater influence on their perceptions of legitimacy. This study has some limitations in that it only examines male inmates perceptions. Therefore, repetition of this research may give better understanding on inmates legitimacy in prisons. Considering the importance and significance of legitimacy in prisons, however, the findings of this study has considerable contributions and policy implications.

형사사법분야에서 오랫동안 중요한 이슈로 다루어졌던 합법적 정당성(legitimacy)의 연구가 다른 분야보다 교정관련 분야에서는 미진하였다. 그러나 수용자들의 통제와 관리가 중요한 교도소 내의 교도관들에 대한 수용자들의 합법적 정당성에 관한 연구는 다른 형사사법영역보다 더욱 중요하고 매우 의미가 있다. 이러한 연구적인 그리고 실무적인 필요성에 의해 이 연구는 선행연구들과 Tylor 등의 이론적 모델에 근거하여 국내 남성 수용자들이 교도관들에게 가지는 합법적 정당성의 원천요인들과 관련요인들을 분석하였다. 연구자는 관련 이론적 틀에 근거하여 합법적 정당성에 가장 크게 영향을 미치는 요인들로서 절차적 정당성(procedural justice)와 분배적 정당성(distributive justice)이 가장 중요한 원천요인이라고 가정하였다. 연구의 분석을 위해 전국의 교도소에서 수집된 총 213명의 남성 수용자들의 설문조사 자료가 분석되었다. 분석결과는 국외의 선행연구결과들과 이론적 논의에서 제시하는 결과들과 일치하는 결과들을 나타내었다. 즉, 국내 남성수용자들이 교도관들에게 인식하는 합법적 정당성의 원천과 관련요인들의 절차적, 분배적 정당성이라는 것이 발견되었고, 특히, 절차적 정당성의 영향력이 매우 크다는 것을 발견하였다. 단, 이 연구에서 새롭게 적용한 여성교도관들과 관련된 인식요인들은 전체 교도관들에 대한 합법적 정당성에 특별한 영향을 미치지 않는 것으로 나타났다. 그러나 이는 이 연구에서 여성 수용자들이 포함되지 않아서 나타난 결과일 수 있다. 따라서 후속 연구에서는 남성 수용자 뿐만 아니라 여성수용자들도 포함된 분석결과가 제시될 필요가 있을 것이다. 마지막으로 이 연구의 공헌점, 중요성, 정책적 함의, 그리고 후속연구에 대한 제안 등이 논의되었다.
