To prevent and solve a problem that will too loud a noise occurs due to the night outdoor assembly and demonstration or that may infringe upon public safety and order by change and expand into violent assembly and demonstration due to the night outdoor assembly, demonstration and wearing mask of assembly and demonstration should be made not by the means of the prohibition of night outdoor assembly and demonstration by clause 10 in the law on assembly and demonstration and wearing mask of assembly or demonstration of the revised bill of this same law but by clause 2, 4, 5, 8, 13, 14, 16, 17, 18 and 1 of 20 of this same law to ensure maximum freedom of assembly. Therefore, I agree with the revised bill of this same law to deletion or abolition of article 10 like a revised bill of this same law of number 2005123 on January 17, 2017. But I oppose the several revised bills of this same law to the prohibition of wearing mask of assembly or demonstration. And, I agree with the revised bill of this same law to deletion or abolition of prohibition system for traffic flow of assembly and demonstration and restriction of minimum requirement to traffic flow of assembly and demonstration to ensure maximum freedom of assembly in article 12 like a revised bill of this same law of number 2003421 on November 9, 2016 than article 12 of this same law. Besides, It should be appropriately reduced a range of a main roads of main cities not to be so wide in clause 1 of article 12 of this same law to ensure maximum freedom of assembly. And, it is desirable that promoter and participant of assembly and demonstration can't be punished unfairly by the form of behavior in article 185 of the penal code be revised in the future to be more specific and clear.

야간 옥외 집회나 시위에 의해 지나치게 큰 소음이 유발되거나 야간의 집회·시위 및 복면 집회·시위에 의해 폭력 집회·시위로의 변질·확대로 인한 공적 안전과 질서의 침해 문제 등은 집시법 제2조 제4호와 제5호·제4조·제5조·제8조 제1항과 제5항·제13조·제14조·제16조·제17조·제18조·제20조 제1항 등에 의하여 해결하는 것이 헌법상 과잉금지의 원칙에 위반되지 않으면서 집회의 자유를 최대한 보장해 줄 수 있기 때문에 2017년 1월 17일에 의안번호 제2005123호로 집시법 제10조를 삭제하거나 폐지하는 집시법 개정안에 대해서는 찬성하지만, 복면 집회·시위를 금지하는 집시법 개정안들에 대해서는 반대한다. 그리고 2016년 11월 9일에 의안번호 제2003421호로 집시법 제12조에서 집회·시위시 교통소통을 위한 금지통고 제도를 삭제 또는 폐지하고 집회·시위시 교통소통을 위해 필요한 최소한의 제한을 할 수 있게 하는 집시법 개정안은 현행 집시법 제12조보다 헌법상 집회의 자유가 최대한 보장된다는 점에서 찬성한다. 또한 집시법 제12조 제1항에서 주요 도시의 주요 도로의 범위를 향후 지나치게 광범위하지 않도록 적절하게 축소하여 집회의 자유를 최대한 보장해야 할 것이며, 형법 제185조는 일반 교통방해죄의 행위태양을 향후 좀 더 구체적이고 명확하게 개선을 하여 이로 인하여 집회·시위자가 부당하게 처벌받지 않도록 개선해야 할 것이다.
