In the copyright law, the art work which can be reproduced to the identical form in the article is protected to the applied art work, It is stipulated that the applied art includes the art work realized to the identical form in the article as well as the design. In the industrial design protection act, the design is defined to the protection target and it is specified that the design is the form, shape, color of the article, that is, the design should have the article property which should be realized in the specific article and the article can be the whole of the article as well as “the part of the article”. In all of the copyright law and the industrial design protection action, the design is specified as the protection target for the applied art, and the design must be realized in the article. Related to such an article, in case where the applied art is realized in the identical article and the corresponding article is commercialized to be distributed, the collision problem may be generated in the protection system by both laws. Particularly, in the industrial design protection action, it is interpreted that all articles are not the target of th design but limited to the article which has the independence, however as to the applied art in the copyright law, the constitution which can be reproduced to the identical form in the article and can be independently divided from the article, is the requirement for the establishment, that is, there may be a problem in the interpretation related to the article property in both laws such as it is not clear whether to require even the configuration of the article which is required under the industrial design protection action etc. Accordingly the definition provisions of the article related to the article property of the applied art are needed in both laws, and the judgement standard of the article property for preventing the double protection and the right collision on the applied art work and the applied art design should be established.

저작권법에는 물품에 동일한 형상으로 복제될 수 있는 미술저작물을 응용미술저작물로 보호하고 있다. 응용미술은 물품에 동일 형상으로 구현된 미술저작물뿐만 아니라 디자인도 포함되는 것으로 명문화하고 있다. 디자인보호법에는 디자인을 보호대상으로 규정하고 있고, 디자인이란 물품의 형상․모양․색채라고 특정하고 있다. 즉 디자인은 반드시 특정 물품에 구현되어 있어야 한다는 물품성을 가지고 있어야 하며, 그 물품은 물품의 전체뿐만 아니라 “물품의 부분”도 가능하다. 저작권법과 디자인보호법 모두 응용미술에 대한 보호대상으로 디자인을 특정하고 있고, 그 디자인은 물품에 구현되어야 한다. 이러한 물품과 관련하여 만약 동일한 물품에 응용미술이 구현되고 그 당해 물품이 상품화되어 유통되는 경우, 양법에 의한 보호체계의 충돌문제가 발생하게 된다. 특히 디자인보호법은 모든 물품이 디자인의 대상이 되는 것은 아니고, 독립성이 있는 물품에 한정되는 것으로 해석하고 있지만, 저작권법에서의 응용미술은 물품에 동일한 형상으로 복제될 수 있으면서 그 물품으로부터 독자적으로 구분될 수 있는 것을 성립요건으로 하고 있다. 즉 디자인보호법상에서 요구하고 있는 물품의 형태성까지 요구하는 것인지는 명백하지 않는 등 양법에서의 물품성에 관한 해석이 문제가 될 수 있다. 따라서 양법에 응용미술의 물품성에 관한 물품의 정의 규정이 필요하고, 또 응용미술저작물과 응용미술디자인에 대한 이중보호 및 권리충돌을 방지하기 위한 물품성의 판단기준이 정립되어야 할 것이다.
