Josef Kohler, who was German Law Scholar, has influenced Korean intellectual property laws. The reason why we are interested in him is that he have provided a theoretical basis for the definition of the inventions of Korean Patent Law, and we still use the terms of the intangible rights in Korean substantive laws that he has created in 19th century, and emphasized the nature of intellectual property not as a ideal ownership but as a property that cab be protected. And in 1878, he published a treatise on ‘On the Korean Law’. Although Korean intellectual property laws and law-theories have indirectly been inherited through Japan, Professor Kohler's definition and theories are still affecting Korean intellectual property laws and law-theories, and his theories are also being discussed. One of the most important areas of jurisprudence is thought to be legal legislative history and legal philosophy. Legal research and legal studies on the legal philosophy and legal legislative history in the field of intellectual property law are deemed insufficient. Futhermore, studies and researches on the law scholars are also found to be insufficient. A study of a scholar named Josef Kohler can be the clue to academic demands.

한국어

우리나라의 지적재산권법에 영향을 끼친 학자 중에서 ‘요세프 콜러’라는 독일 법학자가 눈에 띈다. 그 이유는 콜러는 우리 특허법에서 규정하고 있는 발명의 정의에 관한 조항에 이론적 기초를 제공하였고, 아직도 우리나라의 실체법에서 사용하고 있는 무체재산권이라는 용어를 만들었고, 지적재산권을 정신적 이익이라는 점보다는 재산권으로서의 성격을 강조하였다는 점이다. 그리고 1878년도에 ‘한국법에 관하여’라는 논문을 발표하였다. 비록 일본을 통해서 간접적으로 계수된 지적재산권법과 법학이기는 하지만 콜러교수의 정의와 이론은 우리나라의 지적재산권법학과 법제에 영향을 미치고 있고, 이론 역시 아직 회자되고 있다. 법학의 중요한 분야 중의 하나가 법제사, 법철학이라고 생각된다. 우리나라에서 신생학문으로서 지적재산권법학의 분야에서 아직 지적재산권과 관련된 법제사나 법철학적인 연구는 미진하다고 생각된다. 또한, 지적재산권법과 관련된 법학자에 대한 연구 역시 아직 부족한 면이 있다고 판단된다. 비록 개략적이고 간략하지만 요세프 콜러라는 학자에 대한 연구는 이러한 지적재산권법학에서 기초적인 학문적 욕구에 대해서 대표적인 초꼬슴 역할을 할 수 있다고 생각된다.
