The purpose of the police in estimating crowd size at assemblies and protests is to eliminate and prevent threatening factors in advance for public safety and order maintenance by ways of analysis and response. The difference between the police and assembly organizers estimation triggered the debate between the two sides due to the goal distinction. Thus, it made a more accurate calculation of crowd size and the disclosure of the estimation required by the public. This study aims to scrutinize the main reasons concerning the difference between the police and the assembly organizers calculation method and compare them with a Japanese case, including information disclosure of size. This study shows that Japan also has inevitable controversies on the estimation derived from the distinction between the police and protest organizers results. Moreover, protest organizer’s requirement of the information disclosure, including the results of the crowd size estimation made it clear that Japanese police don’t have any special regulations or manuals related to information release of estimations. As for the methodology, Japan uses the ‘density per grid’ model, also known as the ‘Jacobs method’, like Korea. The findings suggest that Korean police are required to improve the current method by excluding passersby and casual attendees in crowd size estimation, developing the IT program to fractionize the grids, drawing colored fluorescent lines on the ground to recognize lines even at night in major protests areas and utilizing panoramic photographing techniques, etc. in addition, since the controversy on the estimation of assembly crowd can also affect faith in policing by the public, police should raise the accuracy of counting and consider some controversial topics such as police officers’ information access authority, legality of rooftop photographing and drone use or aerial filming and politicized information etc.

경찰은 집회시위 시 발생할 수 있는 위해요인을 사전에 제거하고 예방함으로써 안전을 확보하는 한편, 질서를 유지하기 위한 목적으로 이에 대응하기 위해 집회시위 참가인원을 추산한다. 하지만, 이러한 경찰의 추산결과와 목적을 달리하는 주최 측의 추산결과의 차이로 인해 최근 논란이 촉발되면서 보다 정밀한 추산방법에 대한 논의와 함께 경찰의 추산결과 공개 등에 대해서도 논란이 제기되었다. 이 연구는 그런 이유로 경찰과 집회 주최 측의 현행 집회시위 참가인원 추산방법에 대해 비교 검토한 후 우리나라와 유사성이 높은 일본의 사례를 중심으로 집회시위 인원 추산방식 및 추산결과 공개 등 주요 쟁점에 대해 살펴보고, 시사점을 토대로 몇 가지 정책적 제안을 시도하였다. 연구결과 일본 역시 우리나라와 마찬가지로 경찰과 집회 주최 측 간의 추산결과 차이로 인한 논쟁은 물론 이로 인한 정보공개 요청 등이 진행된 바 있고, 경찰의 추산결과 공개 역시 별도의 법령 또는 매뉴얼에 의한 공식적 공개가 아닌, 언론 요구에 따른 비공식적 전달 형태를 유지하고 있었다. 또한 추산방식에 있어서도 한국과 같이 단위 면적 당 밀집도 계산 방식을 기초로 추산하고 있음을 알 수 있었다. 제안컨대, 경찰의 추산 목적에 비추어 볼 때 공공의 질서유지 차원에서 현행과 같이 ‘일시점 최다 인원’ 산출 방식으로 ‘밀도’를 고려한 ‘단위 면적 당 밀집도’ 활용 방식은 유지하되, 일반 유동인구나 우연한 참가자를 제외할 수 있고, 주간은 물론 야간에도 명확히 산출할 수 있도록 주요 집회장소 바닥면에 스퀘어(Square) 형태의 유색 야광 실선 설치 및 폴리스 라인의 적극적 활용 등을 고려하며, 파노라마 방식의 수직 촬영 기술과 전체 집회시위 장소를 단위 면적으로 세분화할 수 있는 프로그램 개발 등도 병행되어야 할 것이다. 아울러 집회시위 추산결과 역시 경찰의 법집행에 대한 국민의 신뢰도 제고에 영향을 미치는 중요한 요인이 될 수 있는 만큼 정보의 정치화 등으로 인한 수용도 저하를 경계하여 추산결과의 정확도 제고와 동시에 정보수집권이나 조망촬영의 적법성 등 향후 드론 촬영이나 항공촬영 등에 수반될 수 있는 다양한 문제들에 대해서도 추가 논의가 필요할 것으로 생각된다.
