This paper conducted a research on the actual status for the establishment of guidelines to handle digital evidence. Conducting a survey targeting investigators and analysts, the results were analyzed. Based on the results of the analysis, it aims to suggest six matters that should be reflected when establishing guidelines to handle digital evidence. First, the easy, simple, and clear procedures would be necessary. Most of the investigators in the site of execution of a warrant have no expertise in digital forensic evidence. Therefore, it would be necessary to have simple and clear procedures that could be easily understood by non-specialists. Second, it would be needed to have procedures considering the site conditions like manpower and equipment. Guidelines and manuals far away from the reality of investigation could be disregarded by investigators. Third, the minimization, integration, and computerization of written document are necessary. Written document should be minimized, integrated, and computerized to relieve investigators' burden. Fourth, it would be necessary to continuously supply, maintain, and repair the newest equipment to the site. Fifth, the investigation environment should be improved to guarantee the participation right of those subject to seizure. All the investigators and analysts pointed out that the current office environment would be too poor to guarantee the participation right of those subject to seizure. The first-line police stations should install an additional analysis room and also secure space for observation. Lastly, it would be necessary to provide continuous education and modification/complementation of guidelines and manuals. Even if guidelines and manuals are produced and distributed to the site, continuous education should be provided to reflect them to the site.

본 논문에서는 경찰의 디지털 증거 처리 가이드라인 제정을 위한 기초 연구로서 일선 경찰 수사관을 대상으로 디지털 증거 처리 실태조사를 실시하였다. 실태조사 결과를 토대로 문제점을 분석하고, 디지털 증거 처리 가이드라인 제정시 반영해야할 사항을 제시하였다. 경찰의 디지털 증거 처리 가이드라인 제정시 반영해야할 사항 6가지를 제시하면 다음과 같다. 첫째, 쉽고 간단명료한 절차가 필요하다. 영장집행 현장에 출동하여, 디지털증거를 압수･수색하는 수사관은 대부분 디지털 포렌식에 대한 전문지식을 가지고 있지 않고 있다. 따라서 비전문가도 쉽게 이해할 수 있는 간단명료한 절차가 필요하다. 둘째, 인력과 장비 등 현장사정을 고려한 절차가 필요하다. 수사현실과 동떨어진 가이드라인과 매뉴얼은 수사관들에게 외면될 수 있다. 현재의 인력과 장비로 적용 가능한 절차가 마련되어야 한다. 셋째, 작성문서 최소화 및 통합, 전산화가 필요하다. 작성문서를 최소화하고 통합할 필요가 있으며, 전산화하여 수사관들의 부담을 덜어줄 필요가 있다. 넷째, 현장에 최신 장비를 보급하고 유지보수를 지속으로 할 필요가 있다. 복제뿐만 아니라 분석까지 가능한 도구를 보급할 필요가 있다. 또한 지속적인 유지보수를 통해 실제 사용도를 높여야 한다. 다섯째, 피압수자 참여권 보장을 위한 수사환경 개선이다. 현재 수사기관 사무실 환경은 피압수자의 참여권을 보장하기에는 매우 열악하다. 별도의 참관실을 설치 운영할 필요가 있다. 마지막으로 지속적인 교육과 가드라인 및 매뉴얼 대한 수정보안이 필요하다.
