The 4th industrial revolution will definitely bring the stage revolution. We cannot forejudge when to occur and how much to influence in the performing arts world. However, alternative human agents' performances becomes diverse in the ways of performing and the kinds. We need to understand the current status and relevant intellectual property rights. This article explains about alternative human digital images in the virtual reality(included augmented reality) and artificial intelligence robots that we have experienced up to now. It also analyses intellectual property rights regarding them. It is necessary to protect the right of publicity for the source person through legislation. Also, this article argue that the right of production of derivative works should be protected for performers under copyright law because there would be many derivative works using the origin performances with high technology in 4th industrial revolution era. Most of all, we need to acknowledge the creativity of performance itself and it's value of intellectual property to achieve the legislation of them.

과학기술의 발달은 무대 표현의 확장을 가져오기도 했지만, 그와 더불어 실연자의 실연기회의 상실을 낳기도 했 다. 그에 따라 실연을 보호하기 위한 지식재산권법제 역시 그 보호범위 확장의 역사가 진행되어 왔다. 이 연구는 4차 산업혁명이 가져올 다양한 변화 중에서 특별히 실연을 대체하는 기술로 인해서 발생하는 실연자의 지식재산권 보호 에 관한 문제를 다루었다. 현재 진행되고 있는 인간대체 실연자의 종류와 방식은 날로 새롭게 출현되고 있기에 이들 에 관한 현황 파악과 지식재산권에 관한 이해를 할 필요가 있다. 본 논문에서는 가상현실에서의 디지털 이미지와 인 공지능 실연자가 실제 인간을 대체하는 실연자로 등장하게 된 현 상황을 이해하고 이들의 출현으로 인해 야기되는 지식재산권의 문제를 다룬다. 가상현실에서 디지털 이미지로 실연이 이루어지는 경우에는 아직 국내에 입법되지 않 은 퍼블리시티권에 대한 입법요구가 더욱 타당성을 얻게 될 것이며, 저작인접권에서 실연자를 위한 2차적 저작물 작 성권의 도입을 할 필요가 생겨난다. 그러나 무엇보다도, 4차 산업혁명이 가져올 실연과 공연제작 변화 방식에 합당한 실연의 법적 보호를 위해서는 실연자체에 대한 지식재산적 가치와 창작성에 대한 인식이 선행될 필요가 있다.
