It is necessary to identify what kind of processes and what structural characteristics they have. 최근 들어 교육정책에 대한 중앙의 교육부와 지방의 시․도교육청 간의 갈등 사례가 점차 증가하고 있다. 우선 시정명령, 직무이행 명령 등의 당사자 간 행정적 개입을 시도하고 해결되지 않을 경우 시정․이행명령 취소 청구소송, 권한쟁의심판 등 사법적 개입이 진행된다. 교육정책갈등에 대한 행정적, 사법적, 입법적 개입과정을 살펴보면 정치적 이념 차이, 근거 법령 미비, 법령해석의 차이, 권한 배분의 모호성, 관련 단체의 집단적 반대 등 다양한 양상을 가지고 있으며 갈등 해소에 많은 시간과 행정력이 소요되고 정책집행의 지연과 갈등 잠복 등 기회비용 또한 증가하고 있는 실정이다. 이에 본 연구는 중앙과 지방 교육행정기관 간 교육정책 주요 갈등 사례를 대상으로 이러한 갈등이 어떠한 과정과 구조적인 모습을 띄고 있는지를 국가기관간의 권한 관계를 중심으로 개념적으로 분석하고자 한다. 이러한 분석을 통해 중앙과 지방 교육행정기관과의 갈등 예방과 해소를 위한 기초적인 자료로 활용될 수 있기를 기대해본다.
