There are several dispute situations between the States located around the South China Sea in relation with the sovereignty of islets and their maritime jurisdiction in the South China Sea. In addition, the United States have been displaying its power to keep in check China in the South China Sea. While many States pay attention to the situation in the area, the Philippines commenced the Arbitration against China concerning the several conflicts in 2013. In 2016 the Award was delivered, among many submissions this study examines that the law enforcement action of China’s law enforcement vessels has been violated the duty under the United Nations Convention on the Law of the Sea by way of breaching the Convention on the International Regulations for Preventing of Collisions at Sea. And this study presents the points that a government vessels, including KCG’s vessels, need to bear in mind when they operate for law enforcement at sea and the ways of systemic improving.

남중국해에서는 도서 등에 대한 영유권 및 해양관할수역에 대해 여러 국가 간에 분쟁이 발생하였고, 미국도 중국을 견제하기 위해 남중국해에서 그 세력을 과시하고 있다. 많은 국가가 이러한 상황을 주목하는 가운데, 2013년 필리핀이 중국과의 여러 분쟁 상황에 대한 유엔해양법협약을 근거하여 중재재판을 청구하였다. 2016년 남중국해 중재재판의 결과가 나왔고, 그 중에서 본 논문은 해상에서의 법집행시 국제해상충돌예방규칙을 위반한 법집행이 유엔해양법협약상 의무를 위반하였다는 판결의 내용을 검토하였다. 이를 바탕으로 해양경찰 등 우리 정부선박이 해상 법집행시 고려하여야 할 사항과 제도 정비 등에 대한 개선방향을 제시하였다.
