The purpose of this study is that I grope for the role of maritime police for the reality of water leisure activity and safety accident with increase. With the development of scientific technology, we meet new type water leisure equipment, people of using this equipment is growing, As growing the income, people are increasing water leisure activity, but the matter of safety and management of water leisure safety in not under discussion. Together establishment of Ministry of Public Safety and Security(MPSS), MPSS became superintend quarters instead of Maritime Police by water leisure business, but the reality of duty achieve in Maritime Guard Security Headquarters of MPSS, accordingly the management of water leisure is not changed from alteration of government agency. With water leisure many agencies is connected such as a central government, a local government, a public enterprise, a private enterprise, a public corporation. In the Law of Water Leisure Safety, many things are related such as registration of water surface equipment, control license of motor boats, safety education, safety management, safety inspection, water leisure business, insurance and mutual aid benefit and responsibility and compensation of an water accident. It is not easy to establish the direction of argument with water leisure. This paper discussed the role of Maritime Police in the focus of safe accident in with reference to water leisure activities. Maritime Police would play an important role desirably to perform safety matters with water leisure because of taking many maritime equipment and experience of field on water surface.

연구는 증가하고 있는 수상레저 활동의 실태와 그와 관련한 안전사고를 예방할 수 있는 해양경찰의 역할을 모색해 보는 것이 연구의 목적이다. 과학기술의 발달과 더불어 새로운 유형의 수상레저 장비들이 나타나고 있으며 이를 이용하는 사람들의 수도 증가하고 있는 추세이며, 국민들이 소득수준이 향상될수록 수상레저 활동 인구는 늘어나게 되는데 이와 관련한 안전과 관리감독의 문제는 충분히 논의되지 않고 있는 실정이다. 수상레저와 관련된 해양경찰의 업무는 국민안전처의 설립과 함께 국민안전처과 주관 부처가 되었지만 실제 업무 관장은 해양경비안전본부에서 담당하고 있으며 실질적인 관리에 있어서 큰 변화는 없는 상황이다. 현재의 수상레저 관련 정책과 법률은 미비한 측면이 많으며 수상레저에 관한 기본법인 ‘수상레저안전법’은 법의 명칭에서도 알 수 있듯이 안전을 강조하고 있는 규제위주의 법률이다. 수상레저와 관련하여서는 다양한 접근이 이루어질 수밖에 없을 만큼 중앙정부와 지방정부, 중앙정부의 다양한 부처들과 공기업, 민간기업, 공익단체 등이 관여하고 있다. 수상레저안전법만 하더라도 등록, 조종면허, 안전교육, 안전관리, 안전검사, 수상레저사업, 보험과 공제, 사고발생시 책임과 보상 문제 등 개별적으로 접근할 수 있는 논제가 많고, 수상레저와 다양한 분야가 관련되어 있어 논의의 방향성을 설정하는 것도 쉬운 일이 아니다. 수상레저 활동과 관련한 안전사고를 중심으로 해양경찰의 역할을 설정하고 수상안전의 문제에서는 수상장비와 수상에서의 경험이 많은 해양경찰이 주도적인 입장에서 역할을 수행하는 것이 바람직할 것이다.
